What the inspector wrote

Licensing Program Analyst (LPA) Rachel Zeron conducted an unannounced case management visit at the facility for the purpose of concluding an investigation pertaining to the facility's submission of an Unusual Incident Report (UIR) received by Licensing on 07/23/2024, the UIR outlined an incident that occurred on 07/22/2024 pertaining to personal rights of a child in care. LPA was granted entry to the Facility and met with Facility Director, Amy Halit and Crystal Reynolds, Director for Chino Hills Kindercare, assisting today. According to the UIR, on Monday, 07/22/2024 at approximately 10:30 am, both Crystal Reynolds and Amy Halit walked the center to conduct an observation of all the classroom. As they entered the 3's classroom, a staff was witnessed pulling Child 1 (C1) by the arm in a rough manner and sat the child down in a chair. C1 was having behavioral issues that day and S1 was upset because C1 was hitting her and had just knocked her glasses off her face. S1 was written up and given a coaching by Crystal Reynolds. S1 was also suspended, pending investigation. Based on LPA's interviews and evidence collected, its has been confirmed a Staff member inappropriately handled a child in care. The Facility was found to be in violation of the following Title 22 Regulation: Personal Rights: 101223(a)(3) 101223 Personal Rights: (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. See LIC809D for Type A deficiency Cited during this inspection. Exit interview conducted and report was reviewed with the Facility Director, Amy Halit and Crystal Reynolds. LPA issued a Notice of Site Visit and verified it was posted in a prominent location at the facility. Director understands that the Notice of Site Visit must remain posted for the next 30 days along with a copy of all Type A deficiencies cited during this inspection. A copy of all Type A deficiencies cited during this inspection must also be immediately (within 24 hours of child’s next day in care) given to the parents of all children enrolled in the child care facility and any children enrolled into the child care facility over the next 12 months (at the time of enrollment). Licensees are required to have all parents sign and date the Acknowledgement of Receipt of Licensing Reports (LIC9224) and maintain a copy in each child’s file. A copy of this report (LIC809), Acknowledgement of Receipt of Licensing Reports (LIC9224) and Appeal Rights (LIC9058) were provided during this inspection.
