What the inspector wrote

Licensing Program Analyst (LPA) Blanca Ruiz arrived at the facility to conduct a case management inspection to discuss and follow up on a prior attempted inspection by the Monterey Park Office staff regarding denied access to interview daycare children in attendance; as well as to review Community Care Licensing (CCL) Inspection Authority of the Department. LPA met with Licensee, Teresa Ramos. Facility was toured and census was taken. LPA observed 9 children present. This inspection was conducted in Spanish per licensee\342\200\231s request. It was reported that an attempted visit was conducted on 07/06/2022 by LPA Emiko Bell from the Monterey Park Regional Office at the facility with the purpose to interview children pertaining to another facility pending investigation. Due to language barriers between LPA and licensee, LPA Bell contacted CCL Language Link Interpreter Services and licensee was informed in Spanish the reason for the inspection. However, licensee still refuse to allow LPA to proceed with interviews. During today's inspection regulation related to inspection authority was explained to the licensee and questions were answered. LPA Ruiz clarify to Ms. Ramos that Community Care Licensing (CCL) analysts from different offices have the authority granted to conduct inspection to conduct interviews at her facility as per Title 22 Regulations, Section 102391(a) and (b): Section 102391(a ), which states in part that ...."Any duly authorized officer, employee or agent of the Department shall, upon presentation of proper identification, enter and inspect any place providing personal care, supervision and services, at any time, with or without advance notice, to secure compliance with, or to prevent a violation of the regulations adopted by the Department governing family child care homes. " Section 102391(b), \342\200\234The licensee shall permit the Department to inspect the family childcare home, and to privately interview children or staff, to determine compliance with or to prevent violations of family childcare laws or regulations. The Department shall exercise this authority * as specified in Health and Safety Code Section 1596.8535(a). Further, it was explained to Ms. Ramos to contact Riverside CCL directly if she has any questions at 951 782 4200. Appeal rights were explained on how to take action, if she is cited, once the inspection has been completed. No citation was issued during the last visit regarding access was denied to interview children, because licensing jurisdiction from above facility belong to the Riverside Child Care Regional Office.\302\240 Based on the information gathered, please see LIC809D for cited deficiency of the California Code of Regulations, Title 22, Div. 12. Ms. Ramos was advised to visit CCL website at www.ccld.ca.gov and to print out a copy of Title 22 Regulations and review them on a regular basis, as well as be familiar with videos pertaining to inspection authority to ensure she is always up-to-date on the changes to those regulations. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility for the next 12 months. The Notice of Site Visit and Type A Deficiencies from today\342\200\231s visit must be posted for 30 days. Failure to keep these posted for the entire 30 days will result in an immediate $100 civil penalty for each. An exit interview was conducted, Notice of Site Visit posted, Appeal Rights discussed, a copy of LIC 9224 was also provided to licensee during inspection. A copy of report was provided to the licensee on this date. THIS REPORT MUST BE AVAILABLE TO THE PUBLIC FOR THREE YEARS.
