What the inspector wrote

During LPAs inspection only one car seat was observed in the vehicle but she transports more than 3 children at one time that required . As per California Law Requires: Children age 8 or older, or 4'9'' or taller may use the vehicle seat belt if it fits properly with the lap belt low on the hips touching the upper thighs, and the shoulder belt crossing the center of the chest if children are not tall enough for proper belt fit, they must ride in a booster or car seat. Child(ren) interviewed revealed that they are all bucking themselves without the assistance of the licensee. Children are transported in a facility van and/or car. Based on documentation received, and information obtained during interviews conducted, the preponderance of evidence standard has met.\302\240 The above allegation is SUBSTANTIATED SEE LIC 9099-D for the deficiencies cited Exit interview conducted and report was reviewed with licensee, Teresa Ramos. A Notice of Site Visit and Type A Deficiency was given and must remain posted on, or immediately adjacent to the interior of the main door for 30 days. Appeal Rights discussed and given to facility representative, along with a copy of this report and LIC 9224 was given to the licensee or facility representative. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility for the next 12 months.

    Based on facility record the licensee did not comply with the section cited above. Licensee last fire/disaster drill was conducted on 07/2022 which poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on record review, the licensee did not comply with the section cited above licensee and licensee's assistant have no records of mandated reported training which poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on facility record review, the licensee did not comply with the section cited above in. Licensee did not have copy of immunization records for her assistant which poses/posed a potential health, safety or personal rights risk to persons in care.

    102417(k) Operation of a Family Child Care Home All vehicle occupants must be secured in an appropriate restraint system.This requirement was not met as evidenced by: Information and documentation collected during the course of the investigation revealed that a child(ren) younger than 8 years old has/have being observed by multiple witnesses in the licensee's vehicle without a car seat or booster seat moving around in the back seat while the licensee's vehicle is in motion and/or park outside school grounds. "This is an immediate Health and Safety risk for the children".

    OPERATION OF A FAMILY CHILD CARE HOME: Children shall not be left in parked vehicles.This requirement was not met as evidenced by:Licensee left child(ren) alone in a parked vehicle outside school(s) ground while she was picking up or dropping off other child(ren) which takes between 3-5 minutes. Ages Pre-K to 9 grade. Per licensee's own admission she left child (ren) alone in a parked vehicle with parent/legal guardian authorization.

These rights include, but are not limited to, the following:(1) To be treated with dignity in his/her personal relationship with staff and other persons. This requirement was not met as evidenced by:Witnesses observed the licensee forcing child(ren) who she transports to go into her vehicle(s) crying and/or being force by licensee when children refuse to leave with her. Licensee acknowledged child(ren) being defiant and parent(s)/Legal Guardian of child(ren) having knowledge of the incident in question. It was mentioned by one of the witness that the licensee used harsh language toward the child(ren) when taken from the school grounds.
