What the inspector wrote

Licensing Program Analyst (LPA) Blanca Ruiz arrived at the facility to conduct a Case Management inspection for the purpose of addressing separate matters that were discovered during an inspection 09-CC-20230201174844 at the facility. LPA met with licensee, Teresa Ramos.This inspection was conducted in Spanish per Licensee's request. During the inspection LPA conducted a tour of the facility and census were taken. Information and documentation collected revealed that licensee is providing transportation services for daycare and non-daycare children for approximately 8 different school sites within the Ontario-Montclair School District for Transitional Kinder (TK) to Middle school (MS) students.\302\240 Daycare children's overlap with no daycare children. Witnesses who have observed the licensee picking up and dropping off child(ren) at different school sites disclosed that children have been left in the licensee's vehicles ( white center van and/or gray car) in multiple occasion without adult supervision.\302\240 Other witnesses observed the licensee forcing child(ren) who she transports\302\240 to go into her vehicle(s) crying and/or being force by licensee when children refuse to leave with her. Licensee acknowledged child(ren) being defiant and parent(s)/Legal Guardian of child(ren) having knowledge of the incident in question. It was mentioned by one of the witness that the licensee used harsh language toward the child(ren) when taken from the school grounds. Children disclosed feeling helpless and concern of being left alone in the vehicle without adult supervision and/or with other children they do not know.\302\240 Child(ren) ages ranges from 2 years old to 13 years old.\302\240 Licensee provided conflicting statements regarding the number of children who she transports on a daily basis and refused to verify all the children including age and full name. During the inspection conducted on 03/08/23, licensee also acknowledged leaving Child N.1 by himself in her vehicle with the authorization of child's parent without her supervision because it was raining really hard and she had to drop off /pick up a T-K and Preschool child(ren) at a school site. Per information obtained by licensee, witnesses and other pertinent parties at the facility, the following deficiencies were cited as per Title 22. Personal Rights Operation of Family Child Care Home Please See LIC 809-D for deficiency cited Exit interview conducted and report was reviewed with licensee, Teresa Ramos. A Notice of Site Visit and Type A Deficiency was given and must remain posted on, or immediately adjacent to the interior of the main door for 30 days. Appeal Rights discussed and given to facility representative, along with a copy of this report and LIC 9224 was given to the licensee or facility representative. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility for the next 12 months.

    Based on facility record the licensee did not comply with the section cited above. Licensee last fire/disaster drill was conducted on 07/2022 which poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on record review, the licensee did not comply with the section cited above licensee and licensee's assistant have no records of mandated reported training which poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on facility record review, the licensee did not comply with the section cited above in. Licensee did not have copy of immunization records for her assistant which poses/posed a potential health, safety or personal rights risk to persons in care.

    102417(k) Operation of a Family Child Care Home All vehicle occupants must be secured in an appropriate restraint system.This requirement was not met as evidenced by: Information and documentation collected during the course of the investigation revealed that a child(ren) younger than 8 years old has/have being observed by multiple witnesses in the licensee's vehicle without a car seat or booster seat moving around in the back seat while the licensee's vehicle is in motion and/or park outside school grounds. "This is an immediate Health and Safety risk for the children".

    OPERATION OF A FAMILY CHILD CARE HOME: Children shall not be left in parked vehicles.This requirement was not met as evidenced by:Licensee left child(ren) alone in a parked vehicle outside school(s) ground while she was picking up or dropping off other child(ren) which takes between 3-5 minutes. Ages Pre-K to 9 grade. Per licensee's own admission she left child (ren) alone in a parked vehicle with parent/legal guardian authorization.
