What the inspector wrote

On 8/28/24 at 8:15 am, Licensing Program Analyst conducted a subsequent case management/deficiencies investigation to deliver final determination. LPA toured the facility and took a census. A subsequent case management visit is being conducted in response to the receipt of an unusual incident report (UIR) from the facility. The UIR was received by the licensing agency on 8/13/24. It indicates that a staff inappropriately handled a child. Facility staff were interviewed. Based on information received there is a violation of title 22 regulations. The following violation has been identified: Staff stated a child was inappropriately handled by another staff. Staff stated the child was not injured; however, the child received an unusual punishment and was inappropriately grabbed by the staff member. 101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. Facility staff notified parent and CCL immediately. See LIC809D for cited deficiency of the California Code of Regulations, Title 22, Div. 12. An exit interview was conducted, appeal rights discussed, notice of site visit and a copy of this report was provided to facility staff. Notice of Site Visit must be posted for 30 days.
