What the inspector wrote

Due to required lead testing requirements, Licensing Program Analyst (LPA), Susan Brewer conducted a Case Management inspection based on lead testing results received on the facility. LPA S.Brewer toured the facility, took census and met with Licensee Director Wendy Leath, to further discuss lead results received and measures taken for remediation of lead exceedances. During the inspection, LPA toured and obtained photos of the following water outlets identified with lead exceedances in a report dated 08/18/2022: Outlet J, 6.61 ppb, which is a sink located in the toddler\342\200\231s restroom and Outlet M, 8.18 ppb, which is a sink located in the infant\342\200\231s restroom. LPA observed and obtained photos of required signage posted at outlets for cessation of use. It was determined by the LPA through a review of records and observation, that the sinks identified for the infant and toddler restrooms, are not used for consumption/drinking or food preparation and both sinks are closed off to staff and children at the facility for any type of water source. The facility implemented a plan of action and completed repair and replacement of parts for outlets identified in the initial testing reports issued on 08/18/2022. A report dated 11/07/2022 indicates that outlets were retested. Outlet A/A30 (same as outlet J) resulted 1.58 ppb and Outlet B/B30 (same as outlet M) resulted <1.00 ppb, no longer detecting a lead exceedance. LPA observed the infant/toddler restrooms are utilized as storage rooms only. However, LPA S. Brewer, inquired about the sources of water for consumption and the identified location of the sources. Per director W. Leath, water for the infant program is provided by the parent and/or authorized representative and water for the toddler program is obtained by kitchen tap water. LPA toured the kitchen area where 3 kitchen sink faucets are used by facility staff for re-filling water jugs/pitchers and for food preparation to serve infant toddlers. After review of the facility map and list of outlets identified in the test results provided from reports dated 08/18/2022 and 11/07/2022, the A-Tech Consulting Inc, did not conduct testing on the 3 outlets, observed by the LPA as kitchen sink faucets. The licensee was unable to provide proof of lead testing conducted for 364813349 Tutor Time Child Care Learning Center\342\200\231s kitchen sinks/faucets. Based on the LPA's record review and observations, it was revealed that the agency failed to have a total of 3 kitchen sink faucets tested for safe lead levels of 5.5 ppb or below, where staff currently use the faucets as water sources for the Infant/Toddler classroom. Therefore, it was determined that the facility did not meet compliance with this standard as described in the written directives outlined in PIN 21-21-CCP. Additionally, the following resources were discussed and provided from PIN 21-21-CCP dated July 28, 2021 and PIN 21-21.1-CCP December 28, 2022. 101700.6 Grant Funding for Qualifying Child care Centers (a) Senate Bill 862, Chapter 449, Statutes of 2018 allocated $5 Million to the State Water Resources Control Board for testing and remediation of lead in the drinking water of Child Care Centers based on the following criteria: (1) Those that serve children zero to five years of age, with the highest priority for Child Care Centers that provide care for children zero to three years of age. (2) Those that have 50 percent or more of their registered children who receive subsidized care. (3) Those that operate only one facility. (b) To determine a Child Care Center\342\200\231s eligibility for possible funding the Department will provide access to a link to an online eligibility form located on the Department\342\200\231s website and on Sacramento State\342\200\231s Office of Water Programs website. (1) A Child Care Center interested in financial assistance shall complete the eligibility form, which shall include instructions for completing and returning it, prior to receiving any grant funding for which it may qualify. To determine a Child Care Center\342\200\231s eligibility for possible funding, the provider will need to complete an online eligibility form available at Office of Water Programs\342\200\231 website Due to the agency not taking action to test for the Infant program as required in the Health and Safety Code Section 1597.16(a)(1), where all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, deficiency has been cited. See LIC809D. An exit interview was conducted, and appeal rights discussed. LPA S. Brewer provided Director Wendy Leath, with a copy of this report, appeal rights and notice of site visit. This report must be made available to the public upon request for three years.
