What the inspector wrote

First Allegation of Personal Rights: It was alleged that the Licensee forced day care child to stay in another dwelling for an extended period of time while in care. On 07/11/2023 at 10:42 AM, during an inspection for a separate matter, LPAs Susan Brewer and Laura Mejorado, toured the a facility and observed a daycare child in a separate detached dwelling. The Licensee stated, the child was visiting and not enrolled in the daycare. LPA's interviews with pertinent parties revealed the licensee Jocelyn Roces-Lopez, placed the daycare child in detached dwelling that was not open to daycare, against their will and instructed the child to remain hidden from licensing representatives during the inspection. LPAs observed the daycare child to be scared, shaking, and did not understand why they were placed in the detached dwelling. It was also revealed that the licensee failed to report the detached dwelling as a new construction, by failing submit an updated LIC999A Facility Sketches, to Community Care Licensing (CCL), for notification of changes to the physical plant. Therefore, the allegation that the Licensee Jocelyn Roces-Lopez forced day care child to stay in another dwelling for an extended period of time while in care, is Substantiated. The violation was addressed during the previous inspection on 07/11/2023. 2nd Allegation of Supervision: It was alleged that the Licensee left day care child unsupervised for an extended period of time while in care. On 07/11/2023 at 10:42 AM, during an inspection for a separate matter, LPAs Susan Brewer and Laura Mejorado, toured the facility and observed a daycare child in a detached dwelling, and under the supervision of an adult male. LPAs interviewed the licensee Jocelyn Roces-Lopez, who stated the adult male was associated and provided the LPAs with a false name. The licensee stated the child was not part of the daycare, but later retracted their initial statement during the inspection and confirmed that child was enrolled in daycare. LPA's record review, revealed the subject child was enrolled in the Roces-Lopez daycare in June 2023. On 07/14/2023, further investigation revealed the adult male supervising the subject child was a resident of the home, however, the adult male was not associated, employed or approved to reside and/or work at the facility, and did not know the subject child. In addition, the adult male was unaware the subject child observed, in the presence of the adult male on 07/11/2023, was under their supervision for 30 minutes. Therefore, the allegation that the Licensee Jocelyn Roces-Lopez, left day care child unsupervised for an extended period of time while in care, is Substantiated. Based on LPA\342\200\231s observations, interviews and record reviews, which were conducted, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22, divisions, sections 102417(a) Operation of a Family Child Care Home is being cited on the attached LIC9099D, for a Type A citation. ***Continued on LIC9099C, Page 3*** The California Code of Regulations, Title 22, division 12, 102423(a)(2) Personal Rights violation related to this allegation was substantiated and addressed, during a separate inspection on 07/11/2023 on LIC809D Type A citation issued. LPAs Susan Brewer and Laura Mejorado, informed licensee Jocelyn Roces-Lopez, that this report dated document of a Type A citation, which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPAs Susan Brewer and Laura Mejorado, informed the licensee Jocelyn Roces-Lopez, to provide a copy of this licensing report dated 09/14/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview was conducted and a copy of this report was provided to the Licensee Jocelyn Roces-Lopez.

    102417(a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times... the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence.This regulation was not met as evidenced by: Based on LPA observations, interviews & record review, on 07/11/2023 the licensee placed a subject child under the supervision of an uncleared adult without the adult's knowledge, which is an immediate risk to the health & safety of the children in care.

    (d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility:(1) Obtain a California clearance or a criminal record exemption...This requirement is not met as evidence by: Based on observation, interview and Licensees admission, S1 and S2 assisted with the daycare without obtaining a criminal record clearance, which poses an immediate Health, Safety, or Personal Rights risk to persons in care.
