What the inspector wrote

It was alleged that a staff member handled a child in a rough manner by elbowing the child. LPA interviewed all pertinent parties, including staff. During interviews with all pertinent parties, there was conflicting information provided about whether a staff member elbowed a child. A second allegation stated that staff did not allow children to have water during outside play. LPA interviewed all pertinent parties, including staff. During interviews with pertinent parties, it was disclosed that a staff member had asked a child to put their water bottle down to talk about a conflict between them and another child; however, there was conflicting information about whether the child was denied water. Based on interviews conducted, there is conflicting information from what has been alleged; therefore, the allegations are UNSUBSTANTIATED. A finding of unsubstantiated means although the allegations may have happened, or are valid, there is not a preponderance of evidence to prove the allegations occurred. An exit interview was conducted with the director, Brenda Limon Alfaro. Appeal Rights were discussed and issued, a copy of this report was provided, and a Notice of Site (NOS) Visit was issued. The Notice of Site Visit (LIC9213) shall be posted where the parent/guardian of children enter and exit the facility and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. A copy of this report must be made available for the next three years.

This was not met as evidenced by: Upon record review, LPA determined that a staff was not on the facility roster, nor fingerprint cleared, which was not met during this visit. This poses an immediate health/safety risk to children in care.
