What the inspector wrote

On December 8, 2025 at 09:01 A.M, Licensing Program Analyst (LPA) Zirbes met with Licensee Lisa Burtner to conduct an unannounced case management inspection. The purpose of the case management was to follow up on a self-reported unusual incident report (UIR) submitted to the Department on November 25, 2025. The unusual incident report was regarding an injury child 1 (C1) received. During this inspection, interviews were with conducted staff 1 (S1) and staff 2 (S2) and the Licensee. Prior to this inspection, interviews were conducted with the Administrator and Parent 1 (P1). Furthermore prior to the inspection LPA completed a record review. LPA attempted to complete confidential child interviews, however due to the ages of the children in the classroom they were unable to communicate details about C1s injury. The information received from the UIR reported that on November 25, 2025, at approximately 10:30am, C1, child 2 (C2) and S1 were in the infant napping room. S1 was gathering shoes and jackets to go outside. S1 observed C1 and C2 playing near the cribs. As S1 was holding C1 hand and walking out of the classroom, C1 started to cry. Staff observed C1s behavior and based on C1 medical history contacted P1. C1 was picked up and taken to urgent care for treatment. A review of the Center records revealed C1 arrived to the Center at 09:05am and was signed out of care at 10:35am. Interviews reported two fully qualified infant teachers (S1 and S2) were providing supervision the day of the incident. During the case management investigation, LPA reviewed C1s health history and enrollment paperwork. Staff reported they did not observed a specific incident that lead to C1s injury. Staff reported C1 was engaged in floor time while in care. Staff denied the personal rights of C1 were violated and specifically denied C1 was grabbed. When LPA interviewed, P1, P1 did not report concerns with the Facility. Report continued on page two Report continued from page one LPA toured the napping classroom, the area was free of hazards at the time of this inspection. Based confidential interviews and record review at this time, the incident does not appear to have been the result of a violation of the Title 22 regulations. LPA advised the Center to update C1 Needs and Services plan. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Licensee, Lisa Burtner.

    Staff-Infant Ratio 101416.5(b): There shall be a ratio of one teacher for every four infants in attendance. This requirements was not met as evidence by: Based on LPA observation, the Licensee did not ensure a ratio of one teacher to every four infant infants in attendance was being met when at 7:50am, S1 was alone and supervising five awake infants. This poses an immediate risk to the health and safety of persons in care.
