What the inspector wrote

On December 8, 2025, at 07:45a.m., Licensing Program Analyst (LPA) Kendal Zirbes conducted an unannounced Health and Safety inspection at the Center and met with Facility Representative Aubrey Smith. LPA disclosed the purpose of the inspection and was granted entry into the facility by the Facility Representative Aubrey Smith. At 07:50a.m. LPA conducted a safety inspection of the Center. During the inspection, LPA observed staff 1 (S1) supervising five infants (Child 1, Child 2, Child 3, Child 4, Child 5) in the infant classroom. S1 expressed the fifth child had just arrived into care and S1 did not know what teacher was suppose to be in the infant classroom with S1. LPA conducted a follow up walk through of the Center at 08:08am and observed a second infant teacher (Staff 2) had joined S1 in the classroom. LPA spoke with the Licensee regarding the infant ratio requirements. Licensee expressed additional school age children were dropped off at the Center who were not on the schedule. Therefore, the staff member who was suppose to go into the infant classroom, stayed with 19 co-mingeling school age and preschool children. Based on LPA observation, at 07:50am, the Center was not meeting the infant ratio requirements as S1 was alone and supervising five infants at 07:50am. The Center was issued a type A citation for California Code of Regulations, Title 22, 101416.5 (b) Staff-Infant Ratio . Refer to the attached LIC 809D. LPA Zirbes informed licensee Lisa Burtner that this report dated December 8, 2025 document(s) one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Report continued on page two Report continued from page one Also, LPA Zirbes informed the licensee to provide a copy of this licensing report dated December 8, 2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Licensee, Lisa Burtner.

This requirements was not met as evidence by: Based on LPA observation, the Licensee did not ensure a ratio of one teacher to every four infant infants in attendance was being met when at 7:50am, S1 was alone and supervising five awake infants. This poses an immediate risk to the health and safety of persons in care.
