What the inspector wrote

Continued from LIC 9099 (Page 2) During a previous visit, LPA did not observe staff force day care children to use the restroom or handle day care children in a rough manner. Records reviewed indicated the schedule of daily activities includes cleaning up, using the restroom, and washing hands to prepare for rest time after lunchtime. Interviews conducted disclosed younger children are encouraged to use the restroom more often. It was disclosed staff use redirection when handling challenging behaviors, including talking with the child in a separate area and providing alternative activities. It was also disclosed parents and authorized representatives are contacted for assistance. There were no disclosures made regarding witnessing staff handling day care children in a rough manner when handling challenging behaviors. Information obtained revealed staff have used physical redirection, such as taking a child’s hand to guide children to a separate area. It is determined there was not sufficient information evident to support the allegations that staff forced a daycare child to use the restroom and handled a daycare child in a rough manner. Based on observations made at the facility, information obtained during interviews, and records reviewed, it is determined that the allegations could not be substantiated or dismissed. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegations are UNSUBSTANTIATED. An exit interview was conducted and report was reviewed with the assistant director, Anna Guzman. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
