What the inspector wrote

Upon receipt of a Type A deficiency, a copy of the licensing report must also be posted for 30 days. The same report must be provided to parents/guardians of children newly enrolled at the facility during the next 12 months & licensee must obtain a signed Acknowledgement of Licensing Reports (LIC 9224) from parent/guardian & place it in each child's file. LPA Calloway investigated allegations of personal rights violations. It was alleged that a staff member yelled at a child, in addition to handling the child roughly. During the investigation, LPA interviewed you, several staff, parents of children in care, and reviewed documentation provided to her. Based on her investigation, LPA Calloway found there was evidence of a staff member raising her voice at a child and closed the complaint with a substantiated finding. In your appeal, you stated that the staff member acted (raised voice) to prevent injury to the student, and that volume does not equal “humiliation, intimidation, ridicule, coercion, threat, mental abuse. After reviewed your appeal and LPA Calloway’s investigation. Based on my review of all relevant information, it is my determination that there was not a preponderance of evidence to either prove or disprove that the staff member raised and/or yelled at child with an intent to violate child’s personal rights. Therefore, the allegation is unsubstantiated and the deficiency dated 07/18/23 the personal rights of a child, Section 101223(a). is dismissed. An exit interview was conducted, and a copy of this report was read, Appeal Rights were discussed, and a Notice of Site Visit, was provided to the Assistant Director, at the facility. A Notice of Site Visit must remain posted for 30 days. Removal of posting is subject to a $100 civil penalty.
