Inspector’s narrative

What the inspector wrote

On date and time listed above, Licensing Program Analyst (LPA) Chase Atherton arrived at the facility to conduct an annual inspection. LPA was granted entry by Licensee, Kimberly Harris. LPA toured the facility, inside and out, reviewed records, and observed and/or discussed the following: Days and hours of operation are Monday- Friday, 7:30 am to 6:00 pm OFF-LIMIT AREAS INCLUDE: Living Room, Bedrooms, Garage, and partial backyard The inspection consisted of reviews of the CARE tool domains. The inspection found the facility to be in compliance except as noted on the LIC809D. Deficiencies were cited this visit. - The facility is operating within the licensed capacity but DID NOT operate within appropriate ratios for 45 minutes of the visit. At 12:24pm LPA observed the Licensee and 1 adult assistant at the facility. At 1:15pm an interview with the licensee stated that the assistant had left the facility. At 2:00pm LPA observed a different adult assistant enter the facility. This does not comply with Title 22 in that, if a Large facility has no assistant present, they need to comply with the Small facility's ratio requirements. The ratio requirements of a Small facility only allow for 2 infants to be present when 8 total children are present. Therefore, for 45 minutes the facility did not comply with these requirements because: the facility had 3 infants present when there should have only been 2. After those 45 minutes, when a different assistant arrived at 2:00pm, the facility was brought back into compliance. The facility was out of compliance in this way for a total of 45 minutes, during nap time. SEE LIC809D for deficiency cited. 1 Licensee is present in the home and appropriate supervision is provided. However, 1 other licensee is not in the home. SEE LIC809D for deficiency cited. A working telephone is present. Appropriate fire extinguisher is present. Smoke and carbon monoxide detectors are present and were tested by the Licensee during this inspection. All hazardous items are inaccessible which could pose a danger to children. Storage of poisons/toxins are NOT locked. SEE LIC809D for deficiency cited. Fireplace is properly screened: metal screen Facility is clean, orderly and has adequate heating and ventilation. Facility has safe and age-appropriate toys for both indoor and outdoor activities. Outdoor play area is fenced. Verification of control of property on file. License, Emergency Disaster Plan (LIC610) and Earthquake Preparedness Checklist (LIC9148) Parent\342\200\231s Rights Poster (PUB393), Personal Rights, Child Car Seat Law are posted. Pediatric CPR and First Aid Card expires on: 5/25/2025 Health & Safety Certificate - completed on: 10/29/11 & 6/23/12 Mandated reporter: 3/2026 Fire clearance: 8/24/16 Documentation of fire & earthquake completed. Last drill: 5/12/2025 Children\342\200\231s records are NOT complete. SEE LIC809D for deficiency cited. Additionally SEE LIC9102TV which is an advisory note and is NOT a deficiencies. Employee records NOT are complete. SEE LIC809D for deficiency cited. No guns or weapons present as stated by the Licensee. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 regulations. There are no bodies of water during this visit. Licensee understands all bodies of water must be properly covered or fenced per Title 22 regulations. The Department must be notified before and after installation of the above types of bodies of water. Additionally, the following was reviewed with Licensee: - AB 1207 \342\200\223 Mandated Child Abuse Reporting: Child Day Care Personnel Training, beginning January 1, 2018 \342\200\223 Requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. - AB2960 \342\200\223 Childcare and development services, online portal \342\200\223 Effective June 20, 2022 - This bill requires the State Superintendent of Public Instruction (SSPI), within the California Department of Education (CDE), to develop and post on CDE's website a comprehensive child care and development services online portal for families and providers by June 30, 2022. - Effective January 1, 2017 \342\200\223 Children under 2 years of age shall ride in a rear-facing car seat unless the child weighs 40 or more pounds OR is 40 or more inches tall. For additional information regarding car seat laws see www.chp.ca.gov -Licensee provided the Unusual Incident Reporting email: UnusualIncidentReportsDO09@dss.ca.gov -The Duty Officer is available to answer questions Mon. \342\200\223 Fri. at 1-844-LET-US-NO (1-844-538-8766) -Access to forms & Regulations for Family Child Care Homes online at www.ccld.ca.gov -There is a responsibility to know the regulations for anyone providing care. -Failure to meet the posting requirements shall result in an immediate civil penalty. To receive important licensed related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-care-licensing/subscribe and select the Child Care option to receive email communication MyChildCarePlan.org \342\200\223 Centers and Family Child Care Homes Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: https://www.ada.gov/resources/child-care-centers/ . - Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. - LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep web page at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. - To improve the quality and value of the new inspection process, a survey may be sent to the email address provided. For additional information regarding the inspection and its tools and methods, please visit the Program website at www.cdss.ca.gov/inforesources/community-care-licensing/inspection-process. - LPA Atherton informed Licensee Kimberly Harris that this report dated 5/16/2025 document(s) 1 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. - Also, LPA Atherton informed the Licensee Kimberly Harris to provide a copy of this licensing report dated 5/16/2025 that documents any Type A citation(s) to parents of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. - During the exit interview, the Licensee Kimberly Harris, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Exit interview conducted and report was reviewed with the licensee Kimberly Harris. A notice of site visit was given and must remain posted for 30 days.

  • PERSONNEL RECORDS

    Based on record review, the licensee did not comply with the section cited above in that the files for Staff 2 (S2), and S3 did not have LIC9052 available to review. Also, the file for S3 did not have Mandated Reporter Training available to review, which poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on observation and interview, the licensee did not comply with the section cited above in that from 1:15pm to 2:00pm the facility did not have an assistant present. The facility had 8 total children present with 3 of them being infants. The regulations state that there can only be 2 infants present when there are 8 total children present. This poses an immediate health, safety or personal rights risk to persons in care.

    OPERATION OF A FAMILY CHILD CARE HOME

    Based on observation and interview, the licensee did not comply with the section cited above in that the Licensee Lencee Harris was not present at the facility the entire day. Even though 1 of the 2 licensees has been present the entire day, the Licensee Lencee's temporary absence has exceeded more than 20% of the hours that the facility operates, which poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on observation, the licensee did not comply with the section cited above in that their were 2 cleaners that noted to call poison control if ingested. These 2 poisons were not accessible to children in care and were in a cabinet that did not have any handles, that was also barricaded by a heavy stepping stool. However, this does not count as being "locked" per the above regulation. This poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on record review, the licensee did not comply with the section cited above in that Child 2 (C2) and C3 did not have a completed LIC9227 which poses/posed a potential health, safety or personal rights risk to persons in care.
