What the inspector wrote

Allegation #2: Staff allows pacifiers attached to clips. During the investigation, LPA Villa conducted file reviews, observations, and interviewed complaint relevant parties. The investigation revealed there is one child who uses a pacifier clip, however, staff are not allowing the child to have the clip while sleeping. According to Title 22, Section 101439, Infant Care Center Sleeping Equipment, Cribs shall be free from all loose articles and objects, including blankets and pillows. (1) Pacifiers shall be allowed in the crib if the following provisions are in place: (A) There shall not be anything attached to the pacifier. Staff stated the children are allowed a pacifier but the clips are removed and stored in the infant's cubby. LPA observed infant clips in cubbies during nap time. B ased on interviews and observation, this allegation is unsubstantiated. Allegation #3: Staff transporting day care child(ren) while sitting in highchair. LPA Villa conducted file reviews, observations, and interviewed complaint relevant parties. Staff interviews revealed the procedure of cleaning up after meal times does include moving the high chairs used to the off limits portion of the room. The gate separating the areas is approximately 4 feet and staff are not physically able to life the chairs while children are seated in them. Center staff acknowledges this practice is unsafe and stated they do not lift children seated in chairs. Based on interviews and observation, this allegation is unsubstantiated. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegations are UNSUBSTANTIATED. Exit interview conducted with Licensee. A copy of this report, appeal rights and Notice of Site Visit were left with Licensee. Based on the interviews and documentation received the allegation that staff are swaddling infants is substantiated. A finding that the complaint is substantiated means that the allegation happened or is valid, there is preponderance of evidence to prove that the alleged occurred. Exit interview was conducted and the Notice of Site Visit was provided, and LPA observed posting. Licensee is advised it must remain posted for 30 days. An exit interview was conducted, A copy of this report and Appeal Rights were discussed and provided. Signature at the bottom of this report confirms receipt.
