What the inspector wrote

It was alleged that on or about December 22, 2023, a child \342\200\234was lost in the care\342\200\235 and found in the bathroom about 15 minutes later, \342\200\234crying [their] eyes out\342\200\235. Allegedly, the music was so loud, that no one heard the child crying in the bathroom. It was alleged that the child may have been crying before and put in the restroom as punishment, and the music was put up to tune the child out. During the course of the investigation, LPA made her own observations, collected and reviewed documentation, and interviewed pertinent parties. Children\342\200\231s interviews indicated that the daycare is a fun place to come to and that the door to the restroom is left open. Other interviews disclosed that there are no locks on the door. Other interviews also indicated that the subject child would turn the lights on and off to the restroom and run away. During observations, LPA noted that the door handle to the on-limits restroom, near the kitchen does have a lock on it, but can be open from both, the inside and the outside. LPA locked the door from the outside and went into the restroom and closed the door. LPA was able to push the door handle down and get out without any issues. Although the lock on the door moves from vertical to diagonal, it is not a true lock, since the door still opens regardless of which way it is. Based on information obtained during this investigation and through interviews conducted, the review of pertinent documentation, and after receiving conflicting information, the above allegations are UNSUBSTANTIATED. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegation occurred. An exit interview was conducted with the assistant, Leora Green. Appeal Rights were discussed and issued, and a copy of this report, along with a Notice of Site was provided. Upon receipt of this report, the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report must be made available upon request for the next three years.

    Based on record review, the licensee did not comply with the section cited above. 1 out of 4 children did not have the LIC995A signed by a parent/authorized representative. Although the form was on file, it was not filled out and signed off by the parent/authorized representative. This poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on record review, the licensee did not comply with the section cited above. There were no 15 minute checks available for review. Assistant stated that they do them, but could not locate where they are stored. This poses/posed a potential health, safety or personal rights risk to persons in care.
