What the inspector wrote

On date and time listed above, Licensing Program Analyst (LPA) Chase Atherton arrived at the facility to conduct annual inspection. LPA was granted entry by facility representative Lydia Mena. LPA toured the facility inside and out, reviewed records, took a census at the start of this visit, and observed and/or discussed the following: Days and hours of operation are Monday - Friday; 6:30 AM- 6:30 PM.. The inspection consisted of reviews of the CARE tool domains. The inspection found the facility to be in compliance except as noted on the LIC809D. Deficiencies were cited this visit. If updates are made, facility representative will submit the following documents to Licensing within 30 days: 1. LIC 500 Personnel Report 2. LIC 610 Emergency & Disaster Plan 3. Parent Handbook/ Program Curriculum/Admission policies and procedures/ fee schedule 4. LIC 309 Administrative Organization and 5. LIC 308 Designation of Administrative Responsibility · The following items have been posted and are current: License; Emergency Disaster Plan (LIC610); Facility sketch; Earthquake Preparedness Checklist (LIC9148; Parent’s Rights Poster (PUB393); Personal Rights (LIC613A); Child Car Seat Law, and Menu · Facility is operating within the scope of license with appropriate ratios & supervision during this inspection. · Medications are stored inaccessible to children in the Director's office. · Hazardous and dangerous items are stored inaccessible to children. Poisons and toxins are locked. · Classrooms and floors are clean, free of hazards and rooms are equipped with age-appropriate furniture. · Bathrooms were observed to be safe, sanitary and in operating condition · Per facility representative Pamela Fox, no weapons are stored at the facility. · There are no accessible bodies of water present. All wading pools or similar product must be emptied immediately after use and stored in an upright position. · Outdoor activity areas are enclosed by appropriate fences, free of hazards and have age and size appropriate equipment in good condition. · Areas around or under high climbing equipment have material that absorbs a fall: no high climb equipment · Food preparation area is clean, free of litter, and vermin. Food is stored appropriately and protected from contamination. · Menus are current, posted and visible for authorized representatives and available upon request · Measures are taken to keep the facility free of pests and rodents. · Storage containers for solid waste have tight-fitting covers in good repair. · Uncontaminated drinking water is readily available both indoors and outdoors by water bottles and water fountains. · Sign in/Sign out record was reviewed and meets regulation requirements. · A Staff member is present with CPR/First Aid which expires on 3/2026 · Opening and closing staff member’s CPR/First Aid expires on 3/2026 · Director completed Health and Safety Training · Children/Infant files are NOT complete. LPA reviewed files which showed that 2/5 infants files did not contain a Health Assessment within 30 days of the child's enrollment date, which does not comply with Title 22 requirements. SEE LIC809D for deficiency cited. · Individual Infant needs and service plans are complete and current for each infant. · Infants younger than 12 months old have a sleeping plan LIC9227 on file. SEE LIC9102TV for advisory note issued regarding the completion of the LIC9227, this is not a deficiency. · Infants have documentation of 15-minute checks with date, name, time of checks and staff initials. · Staff have received on-the-job training for housekeeping, sanitation and universal health precautions. · Staff files are complete. · Fire & earthquake drills are conducted/documented every six months. Last drill dated: 3/5/26 · Facility representative was informed the Department has inspection authority per Health and Safety Codes. Facility representative was reminded of the following: · Unusual Incident Reporting email: UnusualIncidentReportsDO09@dss.ca.gov · Duty Officer availability: Mon. – Fri 8:00 am – 5:00 pm. at 1-844-LET-US-NO (1-844-538-8766) · Access to forms & Regulations online at www.ccld.ca.gov · Facility staff are responsible to know the regulations for providing care · Failure to meet the posting requirements shall result in an immediate civil penalty. · To receive important licensed -related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-care-licensing/subscribe and select the Child Care option to receive email communication. · AB 1207 – Mandated Child Abuse Reporting: Child Day Care Personnel Training, beginning January 1, 2018 – Requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. · AB2960 – Childcare and development services, online portal – Effective June 20, 2022 - This bill requires the State Superintendent of Public Instruction (SSPI), within the California Department of Education (CDE), to develop and post on CDE's website a comprehensive childcare and development services online portal for families and providers by June 30, 2022. · Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California. · Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. · CCC DID NOT COMPLETE TESTING AND DOES NOT NEED TO COMPLETE TESTING: Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test as specified in Health and Safety Code section 1597.16. For childcare center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP.). LPA verified that the lead testing was completed in accordance to the Written Directives (Interim Licensing Standards) outlined in PIN 21-21.1-CCP. LPA referred facility representative to the Department website for lead: Lead Toxicity Prevention and Water Testing Information ( https://www.cdss.ca.gov/inforesources/child-care-licensing/water-testing-information ) Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for and removing any recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. During the exit interview, the facility representative Pamela Fox confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS A notice of site visit was given and must remain posted for 30 days.     CHILD'S MEDICAL ASSESSMENTS

    Based on record review, the licensee did not comply with the section cited above in that 2/5 children's files, Child 3 [C3] & Child 4 [C4], did not contain a written medical assessment. These files also did not contain an appointment date for the medical assessment of the children or a tuberculosis test within 30 days of the children's admission. This poses/posed a potential health, safety or personal rights risk to persons in care.
