What the inspector wrote

LPA Hogue investigated the above allegations and gathered the following information. According to interviews with pertinent parties, it was disclosed that on or about November 15, 2021 at approximately 3:25pm, the Preppers and the Preschool 1 classroom were outside on the playground at the same time. During this time, a child(ren) from the Preppers classroom attempted to play with a child(ren) from the Preschool 1 classroom. According to disclosures, the child(ren) in the Preschool 1 classroom told the child(ren) in the Preppers classroom they did not want to play and kicked the child(ren) in the Preppers classroom. According to facility documentation, the child(ren) in the Preppers classroom was kicked on the "backside," however it is reported the child(ren) was kicked in the leg. LPA Hogue reviewed facility records, specifically Child and Teacher Check In logs and based on records reviewed, LPA Hogue was unable to determine if commingled classrooms (Preppers and Preschool 1 classrooms) were outside with one teacher supervising 24 or more children on the playground. Based on facility records review, teachers in the Preschool 1 and Preppers classroom are not accurately utilizing the Child and Teacher Check In logs. On different days and times, teachers are not signing children in and out of the classroom and teachers are not signing in and out of the their designated classrooms. An Advisory Note-Technical Violation was issued during this inspection. Based on interviews with pertinent parties, there is conflicting information on whether a child(ren) sustained a whelp on their leg or backside and conflicting information on whether one teacher was outside supervising 24 or more children on the playground. Therefore, due to conflicting information found throughout this investigation, the department has determined that although the allegations may have happened or are valid, there is no preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are deemed UNSUBSTANTIATED. Exit interview conducted and report was reviewed with Director Shannon Garcia . A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. No deficiencies were cited during this inspection.
