Inspector’s narrative

What the inspector wrote

A case management visit is being conducted in response to the receipt of an unusual incident report (UIR) from the facility. The UIR was received by the licensing agency on 4/23/26. It indicates that an authorized representative of a child reported that their child stated that a temporary staff member "smacked" them on their butt with a toy while playing outside, multiple times on 4/10/26. No injuries were reported. Pertinent parties were interviewed and facility records were reviewed, including video footage. Based on the information gathered, the following violations have been identified: the licensee did not prevent a temporary staff member from smacking a child in care on the butt with a toy multiple times. The "smacks" would not be considered "gentle" and would not be considered "hard" either. See LIC809D for cited deficiencies of the California Code of Regulations, Title 22, Div. 12. A notice of site visit was given to facility representative Leiann Fabian and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. An exit interview was conducted, appeal rights discussed, and a copy of this report was provided to facility representative Leiann Fabian.

    (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement is not met as evidenced by: Based on interview & record review, the facility did not prevent a child in care from being "smacked" on the butt with a toy, multiple times, by a temporary staff member. The "smacks" would not be considered "gentle" and would not be considered "hard" either. This poses/posed a potential health, safety, or personal rights risk to persons in care.

    Based on observation and interview, the licensee did not comply with the section cited above in that there was 1 volunteer with current criminal record clearance or exemption that was not supervised while providing care and supervision to children in care. This volunteer additionally had enough child care related units to be considered a fully qualified teacher if they were employed by this facility. This poses/posed a potential health, safety or personal rights risk to persons in care.

  • ARTICLE 2. Administration of Child Day Care Licensing

    Based on record review and interview, the licensee did not comply with the section cited above in that 1/5 staff members (Staff 3 [S3]) did not renew their mandated reporter training every two years, their last mandated reporter training expired 2/28/2026. This poses/posed a potential health, safety or personal rights risk to persons in care.
