What the inspector wrote

***This report is been issue to Amended prior report issue on 04/24/23*** Several random inspections have been conducted at this location and facility has been found in substantial compliance the day of the inspection. However, staff records and /or signing sheets requested for review were not available or incomplete. Per Directors Fanny Topete and Fernando Chavez statements, records were not available for review due to change of ownership and computer systems ( Sandbox to Brightwheel) in progress including current/ new staff records at the facility. During the physical inspection at the facility staff and children were observed getting familiar with each other and some children were perceived has having a hard time adapting to new staff. Supervision was perceived as challenging due the change of staff and new environment for children in care. LPA verified that classrooms were in substantial compliance free of any toys and/or objects that could be a potential risk to the children in care. Director expressed to LPA that new staff were getting familiar with couple of children who were missing senior staff who are no longer working at the facility. During the process of the investigation, records were reviewed, and interviews were conducted with pertinent parties. Information obtained during the course of the investigation revealed that a parent/legal guardian at the facility arrived to the preschool room to leave a child and requested information from a new staff ( Staff N.1) member who was also arriving to the preschool room with his/her own child. An additional staff member was in the classroom (Staff N.2) supervising eleven children. The parent in question was demanding from Staff N.1 to let her know the reason why his/her child was send home with items that did not belong to him/her. Staff was unsure of the information requested from the parent/legal guardian and provided an unsatisfactory answer to the parent. Then they both engaged in unpleasant conversation that resulted in a verbal altercation that was taken to the new director's office, Fanny Topete looking for a positive resolution for both parties. It was disclosed by facility director that parent was provided a letter of dis-enrollment the same day. Children are not longer in care since the day of the incident. Per records and interviews conducted facility was within ratio as per Title 22 Preschool/ Teacher to Child ratio 1:12 but within transition to add Staff N.1 to the classrooms. Parent and staff removed themselves from the room to speak about their disagreements away from the classroom leaving Staff N.2 with children. However, signing sheets were not available for review and provided on a later date. Lastly due to the age and developmental stages of children group in classroom, no children interviews were conducted. Based on the information obtained during the course of the investigation, there is conflicting information regarding the allegation and statements provided by staff . Although allegations may have happened or are valid, there is no preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore allegations are deemed Unsubstantiated at this time. An exit interview was conducted, and a copy of this report was provided to facility by Director, Fanny Topete A Notice of Site Visit was given and must remain posted on, or immediately adjacent to the interior of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. THIS REPORT MUST BE AVAILABLE TO THE PUBLIC, UPON THEIR REQUEST, FOR THREE YEARS.
