101221(b)(8)- Child’s Records- (8) Medical assessment, including ambulatory status as specified in Section 101220, and the following health information: This requirement was not met as evidenced by: Based on interview and record review the children's records were missing the medical assessment forms from the child's physician and children were allowed to enroll and remain in the program beyond the thirty (30) day allotment which is a potential health, safety, or personal rights risks to the persons in care.

101212(d)(1)(C)ReportingRequirements (d) Upon the occurrence, during the operation of the child care center of any of the events...report shall be made to the Department...(1)Events reported shall include the following:(C) Any unusual incident...This requirement was not met as evidenced by: Based on interview and record review Child 1 (C1) tried to help get a toy from underneath the changing table when their left hand was caught underneath the table. C1 sustained an injury to the left finger fingernail. Staff provided aid and reported the incident to the parent, but did not report the incident to the Community Care Licensing (CCL) office which is a potential health, safety, or personal rights risk to the persons in care.

101223(a)(2) Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights:(2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement was not met as evidenced by: Based on observation interview and record reivew. LPA observed the diaper changing table inside the classroom with two gapped openings at the bottom on each side. The openings are in reach of the children and they can place their hand inside causing entrapment and/or injury which is a potential health, safety, or personal rights risk to the persons in care

Based on the interview and record review this requirement was not met as the Facility failed to ensure a safe, healthful, and comfortable accommodation and supervision during and after the class wiggly activity on 10/11/22 ,which resulted in C#1 Insert a piece of wiggly eyes Inside her nose . This poses Immediate health, safety, or personal rights risk to a person in care.

Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following:To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning.This requirement was not meet Based on interview and record review Staff #2 was observed pushing child # 1 head down on the table and shouting at Child # 1 to lay down. Which poses an immediate health, safety, or personal right risks to a person in care
