What the inspector wrote

On 09/10/2024 at 10:00 am, Licensing Program Analysts (LPAs) Michelle Hood and Julieta Abrego made an unannounced inspection to follow up on an incident that was disclosed during interviews wherein a child two years old was discovered alone in front of the facility. There were 14 children with three staff on the playground. During today's inspection, LPAs interviewed three staff and Pastor. During interviews with daycare parents and staff on a complaint received on 06/20/2024, it was disclosed a child was found by a female outside of the facility of 111 Orange Avenue, 92118 sometime between 8:00 am and 9:00 am. A daycare parent was approached while leaving the facility by the female asking about the child. The daycare parent immediately took the children inside the facility to a facility staff that were on the facility playground at the time. After review of the facility file, and interviews it was determined the Pastor John Roamer (acting director) did not report the incident to the Licensing Department within twenty-four from the time of the incident and the LIC 624B was not submitted within seven business days. LPA Hood informed Pastor John Roamer that this report dated 09/10/2024 , documents one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk to the health, safety, or personal rights of children in care. Also, LPA Hood informed Pastor John Roamer to provide a copy of this licensing report dated 09/10/2024 , that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. This is a repeat violation because the facility was cited for the same violation on 10/12/2023, for violation of Responsibility for Providing Care and Supervision. An immediate civil penalty of $1000 was assessed for repeated violation within 12 months. An exit interview was conducted with Pastor John Roamer. The Pastor was provided appeal rights (LIC9058) and their signature on this form acknowledges receipt of these rights. Provided Notice of Site Visit. LPAs observed that LIC 9213 was posted. See LIC 809D for a Type A & B deficiency.

    101212 (d)(1)(C)• Reporting Requirements. Upon the occurrence, during the operation of the child care center of any of the events…a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information…shall be submitted to the Department within seven days following the occurrence of such event. Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met by: Based on the admittance of Pastor John Roamer and a file review completed by LPA Hood, the facility did not notify the Dept. within twenty-four hours or submit the LIC 624B (UIR report) within seven days from the day of the incident.   • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229(a)(1) Responsibility for Providing Care and Supervision. The licensee shall provide care and supervision as necessary to meet the children's needs. No child shall be left without the supervision of a teacher at any time... Supervision shall include visual observation. This requirement was not met by: Based on interviews a child was found outside of the facility by a female and daycare parent. Due to facility doors being left open for facility ventiliation a child left the facility. This is a immediate Health and Safety Risk to children in care.
