What the inspector wrote

On 8/30/2023, at 2:45 pm., Licensing Program Analyst (LPA) Vicky Williamson conducted an unannounced case management inspection regarding a self - reported incident. LPA met with Director, Deanne Romero. LPA discussed the purpose of the inspection and was led on a tour of the facility. The following ratios were observed: Infant Classroom 1 had seven (7) infants with two staff and the Toddler Classroom had eight (8) infants with (2) staff. Director stated that on 8/7/2023 at 2:00pm there were two staff and 7 children in the infant classroom during the time of incident. Staff 1(S1) was supervising three infants in the napping area of the classroom, two of whom were napping. Staff 2 (S2) was supervising four (4) infants including Child 1 (C1). Director stated that C1 pushed open the unlocked door inside of the classroom that leads outside to the infant playground. Staff 3 (S3) observed C1 on the playground from the hallway outside of the classroom through a window inside of the classroom. Per Director, C1 was on the playground for approximately 10 minutes without supervision. LPA observed that the infant playground is located directly outside the classroom and has a locked gate entrance. Interviews were conducted with the director, assistant director, staff and authorized representative for C1. A review of video footage disclosed that C1 walked out of the classroom to the infant playground unattended. C1 was on the playground without supervision for 11 minutes. Interviews revealed that the door was left partial open after staff discarded a soiled diaper into the trash can outside of the classroom door. S3 observed C1 on the playground and brought C1 to the Director\342\200\231s office. S3 stated that C1 was observed to be crying, however no medical attention was required. Director stated that C1's authorized representative was contacted immediately. Director stated that staff have been retrained on face to name procedures and each staff has been provided a copy of the instructions. Director stated that she and Assistant Director, Cristina Daniels are observing the infant classrooms to assure that the staff are following the face to name procedures. Director stated that a safety gate has been placed at the door leading out to the playground. See LIC 809C Continuation... Based on interviews and video footage, a Type A deficiency of California Code of Regulations, Title 22, Division 12, Chapter 1, is being cited on the attached LIC 809D. LPA informed Director, Deanne Romero that this report dated 8/30/2023 documents one (1) Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed Director to provide a copy of this licensing report dated 8/30/2023 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA provided Director, Deanne Romero with form LIC 9224. An exit interview was conducted with Director, Deanne Romero, a copy of this report along with the Appeals Rights (LIC 9058) was provided. A Notice of Site Visit is provided and required to be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. LPA observed Director post Notice of Site Visit on the bulletin board at the entrance.

This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above, as Child 1 (C1) exited the classroom alone and was found on the playground without supervision, which poses an immediate health, safety, and personal rights risk to persons in care.
