What the inspector wrote

On 2/27/25 at 12:20 pm Licensing Program Analyst (LPA) Gerald Poindexter conducted case management inspection while at the facility for another matter. LPA met with the licensees Emal and Basmira Amiri (Ms Basmira Amiri left the home before this document was complete). Facility operates Monday through Friday from 6:15 am to 9 pm, with care provided over several shifts. LPA toured the facility’s child care areas and reviewed facility records. LPA observed that: · Several files for children currently enrolled do not have completed LIC282 forms (Section B not complete), immunization records, and Safe Sleep Logs · The licensee, Mr. Amiri’s pediatric CPR/First Aid card expired 1/2025 and his Mandated Reporter Certificate expired 1/10/25 · Outlet Covers were missing from outlets in rooms where children have access · Off-limits and on-limit rooms with chemicals were left accessible to children · Outdoor play equipment (trampoline) did have manufacturer’s guidance for age-appropriateness and swingset did not have safe cushioning for landing See LIC 809D for deficiencies cited Exit interview conducted and report was reviewed with the licensee Emal Amiri. A Notice of Site visit was given and must remain posted for 30 days. Licensee Appeal Rights (LIC 9098), along with a copy of this report, was provided to licensees.

    102417 Operation of a Family Child Care Home (a) When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for the children during their absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. Based on interview with licensees, Ms. Amiri was out of the country for an extended period and was not present 80% of the time the facility was operating. This poses a potential risk to the health and safety of children in care.

    Personnel Requirements: (c) The licensee and other personnel as specified shall complete training on preventive health practices, including pediatric cardiopulmonary resuscitation and pediatric first aid, pursuant to Health and Safety Code Section 1596.866. This requirement is not met as evidenced by: Based on interview and record review, the licensee Emal Amiri did not comply with the section cited above, as his CPR/First aid certificate expired January 2025. This poses a potential health, safety or personal rights risk to persons in care.

This requirement was not met as evidenced by: Swingset did not include cushioning underneath. Trampoline was present for which the license did not have manufacturers instruction for age-appropriateness. These pose a potential health, safety or personal rights risk to persons in care.

    Operation of A Family Child Care Home: (g) The home shall be free from defects or conditions which might endanger a child.This requirement is not met as evidenced by: Based on observation, the licensees did not comply with the section cited above in that several outlets in rooms used to care for children are missing outlet covers which poses a potential health, safety or personal rights risk to persons in care.

    102417(g)(4) Operation of A Family Child Care Home (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (4) Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. This requirement is not met as evidenced by: Based on observation, Fabuloso liquid cleanser in an unlatched bathroom cabinet and Neutrogena sunscreen in an open cosmetic bag, were found accessible in an off-limits and on-limit rooms, respectively. This poses immediate health, safety or personal rights risk to persons in care.

    Immunizations: (g) The licensee shall document each child's immunizations as required by the California Code of Regulations, Title 17, Section 6070, and shall maintain such documentation for as long as the child is enrolled. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above as 7 of 25 children enrolled did have immunization records in their files. This poses a potential health, safety or personal rights risk to persons in care.

    Infant Safe Sleep: The provider shall supervise infants while they are sleeping and adhere to the following requirements: The provider shall check and document the following: This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above in that 3 of 3 three infants in care did not have Safe Sleep Logs on file. This poses a potential health, safety or personal rights risk to persons in care.

  • ARTICLE 2. Administration of Child Day Care Licensing

    Administration of Day Care Licensing: (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider... and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.This requirement is not met as evidenced by: Based on interview and record review, the licensee Emal Amiri did not comply with the section cited above in that Mandated Reporter Training Certificate expired 1/10/25 which poses/ potential health, safety or personal rights risk to persons in care.
