What the inspector wrote

On 2/23/26 at 12:50 pm, Licensing Program Analyst (LPA) Gerald Poindexter conducted an unannounced inspection for an Increase in Capacity application. LPA met with licensee Maria Aguilon. Licensee submitted application to the Department on 12/9/25. Fire clearance report was provided to the Department on 2/19/26. The 3-bedroom, 2-bath, one-story home was toured and inspected to ensure an environment safe for the care and supervision of children. Present in the home were 3 daycare children, with one under 24 months of age. Also, present was the licensee\342\200\231s adult niece, Maria Lopez, a resident of the home and the licensee\342\200\231s helper. During review of this report, the licensee's husband Everaldo Merida Lucas was contacted via telephone at 3:00 pm for English to Spanish translation. The following areas will be used for child care: kitchen, living room, bedroom 2, bathroom 1 and patio for child care operations. Off limit areas are bedroom 1, bedroom 3 that includes bathroom 2 and garage and are inaccessible by use of child safety doorknob covers. Bedrooms 1 and 3 use safety gates to prevent access. Licensee has a fully fenced backyard and patio for outdoor activities. No hazardous items were observed during the inspection. LPA advised that continuous visual supervision is always required during outdoor activities. The facility has sufficient toys and equipment available. No body of water was observed during the time of inspection. The fire extinguisher meets 2A10B requirements and the smoke detector and carbon monoxide detector are operational. All hazardous items were latched/locked and secured out of reach of children. Licensee states that there are no weapons in the home. Pediatric First Aid and CPR certification for licensee expires 2/17/28. Helper, Ms. Lopez\342\200\231 car card expired 2/2026 and she has scheduled for renewal. Licensee and helper have required immunizations. Licensee\342\200\231s and helper\342\200\231s Mandated Reporter Training certificate expires on 7/12/27 . CONTINUED ON PAGE 2 and 7/31/26, respectively. LPA reminded licensee that Mandated Reporter training and Pediatric First Aid and CPR certifications must be renewed every 2 years. LPA observed all required postings were posted Children\342\200\231s records were reviewed and found to be in order. Staff records were reviewed. Licensee maintains a current roster of the children. Licensee moved into the home in September 2025. LPA reminded her that emergency drills must be conducted and documented once every 6 months. Provider is hereby reminded of the following: Report suspected child abuse and neglect, maintain children\342\200\231s records according to regulation, post all required forms; corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers are not allowed in day care. All equipment that is used should be used only as intended by the manufacturer. LPA reminded Licensee that all unusual incident reports shall be submitted to Licensing office via email at SDIncidentReports@dss.ca.gov or via fax at (619)767-2203. Duty officer number is (619) 767-2248. LPA verified that all adults living or working in the home have been fingerprint cleared and associated. Applicant was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. On this date, 2/23/26, the California Attorney General - Megan\342\200\231s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility address. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. California Megan's Law website: www.meganslaw.ca.gov Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families CONTINUED ON PAGE 3 obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. LPA discussed the safe sleep regulations with the applicant and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep , as an additional resource. LPA also informed applicant of the importance of checking for and removing recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/ , and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. No deficiencies cited. A license for 14 children may be issued upon final file review. Licensee was reminded that annual fees are due on the date they were licensee every year. Exit interview conducted and report was reviewed with the licensee Maria Aguilon. During the exit interview, the licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. A Notice of Site Visit was given and must remain posted for 30 days. Appeal Rights provided.
