What the inspector wrote

On 09/14/2022 at 09:30am, Licensing Program Analyst (LPA), Selina Siao, conducted an unannounced inspection to investigate the above allegation. Upon arrival, LPA Siao met with Director Sandrine Butin and conducted a tour of the classrooms and playground. LPA conducted interviews with all staff members that are present today and a few of the staff's records were reviewed. Based on information gathered, it was determined that staff Maria Montenegro that is in the Bigger Dipper (2 year old class) who was alone supervising 6 children is not a qualified teacher. LPA also observed teacher aide Yensenia Robles being alone in the Little Dippers (Toddler room) supervising 4 toddlers as the regular teacher is out this morning. The above allegations are found to be SUBStTANTIATED, which means the preponderance of evidence standard has been met. California Code of Regulations, Title 22, 101216.2(b)(1) is being cited on the attached LIC 9099D. Appeal Rights were discussed and provided.

    Teacher Qualifications and Duties:Prior to employment, a teacher shall meet the requirements of (b)(1) or (b)(2) below: (1) A teacher shall have completed, with passing grades, at least six postsecondary semester or equivalent quarter units of the education requirement specified in (c)(1) below, or shall have obtained a Child Development Assistance Permit issued by the California Commission on Teacher Credentialing. This requirement is not met as the two year old staff Maria Montenegro and teacher aide Yensenia Robles does not have the required units to be teachers and they were observed alone superiving the children during today's inspection. This poses a potential health and safety risk to clients in care.
