What the inspector wrote

On 10/3/24, Licensing Program Analysts (LPAs) Saraliz Velando and Stefanie Mutialu conducted an unannounced case management inspection for a deficiency. A tour of the facility was conducted with the Director, Kimberly Sandoval. There were XX infants and XX staff present today. Room 1 is currently being used for infants but was previously approved for use under the Preschool License. Based on observation and staff interview it was found that the licensee is operating outside the limitations of their license. Type B deficiency is cited on LIC809-D. The exit interview was conducted with the Director, Kimberly Sandoval. Appeal Rights and a copy of the licensing report was provided. A notice of site visit was posted and must remain for 30 days.

    Limitations on Capacity - (a)A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met as evidenced by: Room 1 is currently being used for infants but was previously approved for use under the Preschool License. Based on observation and staff interview it was found that the licensee is operating outside the limitations of their license.

    Infant Care Teacher Qualifications and Duties- (a)Notwithstanding Section 101216.1, the following shall apply:(b)Prior to employment, an infant care teacher shall have completed, with passing grades, at least three postsecondary semesters or equivalent quarter units in early childhood education ... accredited or approved college or university. This requirement was not met as evidenced by: Based on observation and staff interviews conducted by LPAs, 6 infants were being cared for by 2 unqualified staff. This poses/posed a potential health, safety or personal rights risk to the children in care.
