What the inspector wrote

On 1/26/26 at 1:00 pm Licensing Program Analyst (LPA) Gerald Poindexter made an unannounced Plan of Correction (POC) inspection related to the deficiencies cited on 12/19/25. The POC due dates for the deficiencies were1/12/26 and 1/19/26, respectively, which, at the time, was explained to and acknowledged by interim director Tomi Kelly. Today, LPA Poindexter met with Rachelle Wise, director of the Rising Star Fairmount location and facility representative, as designated by the licensee. Observed present today were 2 infants and 2 preschoolers with qualified teacher Belinda Thomas and Juana Alonso. LPA met with Ms. Wise and the following deficiencies cited on 12/19/25 were reviewed: \302\267 Responsibility for Providing Care and Supervision for Infants, Safe Sleep Logs, 101429(a)(2)(c) \302\267 Employees\342\200\246Immunization Requirements, 1596.7995(a)(1) \302\267 Drinking Water, Health and Safety Code 1597.16(a)(1) \302\267 Fixtures, Furniture, Equipment and Supplies, 101239(f)(1) Proof of corrections were provided for 101429(a)(2)(c) and 101239(f)(1). Ms. Wise requested and was granted an extension thru 2/25/26 for 1597.16(a)(1), and provided documentation that arrangements for lead testing are in progress. The deficiency for Employees\342\200\246Immunization Requirements, 1596.7995(a)(1) has not been corrected. Ms. Wise noted that there has been staff turnover since the original 12/19/25 licensing visit and stated that she is working with the employees present today, on securing their immunization records. LPA explained to Ms. Wise that failure to correct the deficiencies by the POC due date can result in a civil penalty of $100 per violation, per day until the violation is corrected. LPA Gerald Poindexter informed Ms. Wise that this report dated 1/26/26 documents and assesses one (1) civil penalty. CONTINUED ON PAGE 2 Please be advised that FAILURE TO PAY the required civil penalty payment may result in the REVOCATION OF YOUR LICENSE. You must respond within 30 days with the payment of or a proposed payment plan that includes the first payment. Further, the Department will not approve any requests for increase in capacity or for additional capacity of additional licenses while civil penalties remain unpaid. Exit interview was conducted with Rachelle Wise, facility representative. LPA reviewed and provided a copy of the licensing report. Appeal rights provided. A Notice of Site Visit was provided and must be posted for 30 days.
