What the inspector wrote

On 04/03/25 at 9:40am, Licensing Program Analysts (LPA), Samantha Clenista and Selina Siao conducted an announced Pre-Licensing inspection for a Change of Ownership. Upon arrival, LPAs met with Center Director, Coralito Garcia. Applicant/Facility Representative, Abhinav Nitharwal and current Facility Representative, Satish Chandra arrived at 10:59am. LPAs observed a total of 18 children present with a total of 4 staff members. Applicant is requesting to be licensed for 19 infants (0 to 2-years-old) in the Toy Story, Sunrise and Spring Room; 22 toddlers (18-36 months) in the Sunny Winter and Summer Room; 23 preschoolers (2 to Kindergarten) in the Autumn Room. Hours of operation will be Monday thru Friday from 7am-5:30pm. All indoor and outdoor activity space utilized for the children was inspected today. LPAs informed all Facility Representatives (Ms. Garcia, Mr. Nitharwal, and Mr. Chandra) that staff are required to maintain direct visual supervision of the children at all times during indoor and outdoor activities. When medications are on site, Facility Representatives stated they are stored in a cabinet located in the office. A fully equipped first aid kit is located in the office. There is an operational carbon monoxide detector on site located in the kitchen. All required licensing documents were observed posted in the lobby area. Children will be signed in and out via Procare App which is located upon entry. LPAs continued to tour the facility and measured all indoor and outdoor activity space. Total indoor activity space for the infants measured at 481.17 sq. ft., which is only sufficient to accommodate 13 infants. Total indoor activity space for the toddlers measured at 742.82 sq. ft., which is sufficient to only accommodate 21 children. Total indoor activity space for the preschoolers measured at 840.01 sq. ft., which is sufficient to accommodate the requested overall capacity of 23 children. LPAs observed all indoor activity space to be complete with safe, age-appropriate furniture and equipment, including tables, chairs, cubbies, napping cots/mats, cribs, bookshelves, and other activity supplies for the children. Infant toys are safe with no sharp edges, splinters, or points, nor made of small parts that can present a choking hazard. Drinking water is available in the classrooms via refillable water jugs supplied by Primo. LPAs observed all hazardous items to be inaccessible to children. Applicant stated and LPAs observed no bodies of water or weapons on the property. Fire clearance was granted on 03/20/2025. In the infant room highchairs have plastic seats and are in good repair. Highchairs are made of washable, moisture-resistant material. Changing tables have at least 1” padding covered with moisture-resistant, washable material. Sides of the changing table are at least 3” high and the changing table is within arm’s reach of a sink. LPAs informed Facility Representatives that the diapering sink shall not be used for meal preparation or dishwashing. Cribs meet regulatory requirements. Crib area is separated from activity space via half wall. This barrier is at least four feet high, made of sound absorbing material and allows for supervision of napping children. There are currently 7 cribs in the crib area. Sleep logs, Needs and Services Plans, and Safe Sleep Plans are kept within the classroom on clipboards. There is one sink available for infants use, 2 toilets and 2 sinks available for toddler use and 4 sinks, 2 toilets and 2 urinals available for preschool use. All sinks and toilets accommodate the requested overall capacity for each program. There is a separate staff restroom equipped with one toilet and one sink. The isolation area for children who are ill will be the office and staff restroom. Facility will provide morning and afternoon snacks. The kitchen area currently includes a refrigerator, freezer chest, microwave, toaster oven and sink. The kitchen area and food storage areas were observed to be free of rodents and/or vermin. Food was observed to be properly stored separate from cleaning materials. Hazardous items in kitchen are inaccessible to children via latch on the kitchen door. The facility currently has only two fully fenced playground areas. There is not a separate toddler playground. Currently, the infants and toddlers share a playground, and an updated waiver shall be requested and approved prior to licensure. Fencing via vertical rot iron is at least four feet high. The total square footage for the toddler playground is 752.73 sq. ft., which is only sufficient to accommodate 10 children. The total square footage for the outdoor activity space for the preschool is 3970.12 sq. ft., which is sufficient to accommodate the requested capacity. Shade is provided via sail shade. There are sufficient outdoor age-appropriate toys and play equipment available on both playgrounds. There is a climbing structure on the preschool playground which is properly anchored and age appropriate . There is one slide located on the shared infant and toddler playground that Facility Representatives stated are only used for the older toddlers. Facility Representatives stated that the younger infants are taken on walks around the facility and do tummy time on the playground for outdoor play. There is adequate cushioning in fall zones of climber provided by rubber matting and/or turf. LPAs observed all hazardous items on the playground to be inaccessible to children. Facility Representatives were reminded that any changes to the facility must be reported to and approved by Community Care Licensing. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). Facility Representatives were reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. LPAs discussed the safe sleep regulations with Facility Representatives and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep , as an additional resource. LPAs also informed Facility Representatives of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/ , and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Facility Representatives were informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. A notice of site visit was given to Facility Representatives and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Exit interview conducted and report was reviewed with the Applicant, Abhinav Nitharwal. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. To receive important licensed related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-care-licensing/subscribe and select the Child Care option to receive email communication. The following corrections are needed prior to the issuance of the license: Make the storage area located in the Autumn Room inaccessible. Request and submit a playground waiver to share the infant playground with toddlers on a staggered basis both in the AM and PM. Obtain an updated fire clearance reflecting updated capacity. Applicant/Licensee Representative, Abhinav Nitharwal, understands that all proof of corrections must be provided to the Department within 30 days, or the application may be denied. LPAs obtained an updated facility sketch reflecting updated classroom names and appropriate placement of toilets and sinks. It is to be noted that the fire clearance states that the maximum occupancy load at the facility shall not exceed 64.
