LIMITATIONS ON CAPACITY

101161- Limitations on Capacity (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement is not met as evidence by: LPA observed 7 preschool children in room 4B with two staff member during today's inspection. The room was previously licensed as an infant room. Room 4B is not an approved room for the preschool. This poses a potential health and safety risk to children in care.

ALTERATIONS TO EXISTING BUILDINGS OR NEW FACILITIES

Alterations to Existing Buildings or New Facilities- (a)Prior to construction or alterations, the licensee shall notify the Department of the proposed change(s). This requirement is not met as evidence by: Facility altered classroom #1 to make it bigger by taking over the church's office spaces during December when the facility was closed. Faciltiy also expanded the outdoor activity space that is located in front of the toddler room. Both alterations were not reported to licensing. This poses a potential health and safety risk to children in care.

SIGN IN AND SIGN OUT

Based on record review, the licensee did not comply with the section cited above in 6 out of 35 children present were not signed in by a parent/guardian. This poses a potential health, safety or personal rights risk to persons in care.

Based on record review and director statement, the licensee did not comply with the section cited above. Facility staff do not maintain 15-minute sleep documentation for the infants enrolled in the toddler program. This poses a potential health, safety or personal rights risk to persons in care.

CRIMINAL RECORD CLEARANCE

101170(e)(1): Criminal Record Clearance:(e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(1) Obtain a California clearance or a criminal record exemption as required by the Department...This requirement was not met as evidenced by: Based on record review staff member Jessica Baltazar has worked at the facility since 11/22/22 without a criminal record clearance. She is also not associated to the facility. This poses an immediate health and safety risk to the children in care.

Health and Safety Code Section 1596.8595. A licensed child care facility or home shall provide to the parents of each child...copies of any licensing report that documents any Type A citation...The requirement was not met as evidenced by: Based on file review and discussion with Director, the 4/29/21 LIC 809 documenting the Non Compliance Conference, was not provided to parents as required. This is a potential hazard to children in care.

Health and Safety Code. Commencing September 1, 2016, a person shall not be employed or volunteer at a family child care home if he or she has not been immunized against influenza, pertussis, and measles or qualifies for an exemption.This requirement was not met as evidenced by: Based on staff file review, SB 792 immunization records were incomplete for Staff 1 thru 6. See LIC 811 for specific documents. This is a potential hazard to children in care.

REPORTING REQUIREMENTS

Reporting Requirements. Upon the occurrence...of any of the events specified in (d)(1).. a report shall be made to the Department within the Department's next working day... Events reported shall include the following: (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement has not been met as evidenced by:Director informed LPA during an interview that she was unaware she was to report that a child was left behind during a fire evacuation on 1/14/21. This is a potential hazard to chidlren in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

Care and Supervision. No child(ren) shall be left without the supervision, including visual observation, of a teacher at any time except as specified in sections 101216.2(e)(1) and 101230(c)(1). This requirement was not met as evidenced by: Director's confirmation that Child #1 was left behind, asleep in the classroom, for approximately 5 to 7 minutes during an evacuation prompted by a fire on the hillside behind the school. This is an immediate hazard to children in care.
