What the inspector wrote

Based on confidential interviews, the preponderance of evidence has been met and the allegation that staff did not use universal precautions with day care children present is substantiated. The facility is cited for Title 22, Section 101238 (a) Building and Grounds which poses a potential health, safety and/or personal rights risk to children in care. An exit interview was conducted, this report, appeal rights and Notice of Site Visit was explained and provided to Director. Director was reminded that the Notice of Site Visit must be posted for 30 consecutive days and failure to post the notice will result in civil penalties of $100.00. Confidential interviews resulted in conflicting information being provided to LPA. Confidential interviews could not confirm the incident did or did not occur; whereas another confidential interview disclosed the C1 had dried blood in C1’s nose when C1 arrived home with a note regarding an incident where C1 was hit in the nose by another child in care. Confidential interview revealed to LPA that there were pictures of C1's bloody clothing and a copy of the note, however the pictures and note were not submitted to LPA as requested. Confidential interviews also disclosed that the child did not receive medical attention once at home and there was no call to parents from CCC regarding the incident. LPA also did not find any incident or ouch reports regarding C1 having a blooding nose, or a bloody nose caused by another child in care. In regard to the allegation that staff left daycare child soiled for an extended period of time, it was alleged that C1 was sent home from daycare soiled on two occasions. It was alleged that on or about March 13 and 14, 2023, when C1 was picked up from school by parents, C1 had pooped on self. On both days parents were advised by C1 after leaving the classroom but prior to leaving the facility that C1 had pooped on self. It was alleged on March 14th, C1 was checked by parent in the parking lot of CCC and C1 had dried poop down to C1’s socks. Confidential interviews resulted in conflicting information being provided to LPA. Confidential interviews disclosed to LPA that the alleged incidents were not recalled; whereas another confidential interview disclosed that the incidents did occur. Confidential interviews also disclosed that the parents never made the school aware of these incidents occurring. Based on confidential interviews, the allegations staff did not prevent daycare child from hitting another child while in care and staff left daycare child soiled for an extended period of time, may have occurred, however are not supported or proven by evidence. Therefore, the allegations are unsubstantiated. A copy of this report, appeal rights and Notice of Site Visit were provided to Director. The Notice of Site Visit was posted by the Director prior to LPA leaving the facility and the Director was reminded this notice must be posted for 30 days.
