What the inspector wrote

Based on confidential interviews conducted during the investigation, the preponderance of evidence standard has been met and the allegation due to lack of supervision a daycare child was lost is substantiated. The facility is being cited for Title 22 Regulations Section 101229 (a) (1) Responsibility for Providing Care & Supervision. See LIC 9099-D for cited deficiencies. An LIC 9224 was provided and must be signed by parents as well as new enrollees for the next 12 months. An exit interview was conducted, appeal rights were discussed, and a copy of this report was provided to Owner Sally Chenoweth. A notice of site visit was also provided and must remain posted for 30 days. Further interviews revealed, AD does have a loud voice and is stern, however, AD has not been heard to yell at children in a belittling or inappropriate way. Interviews with children revealed AD does not yell at or grab children in a rough way. AD stated she does have a loud voice, however, AD does not yell at children. AD also stated she does not grab or handle children in a rough manner, although AD will quickly grab a child’s hand or arm if AD is able to prevent a child from hitting or hurting another child. Based on conflicting statements, the allegations that AD handles daycare children in a rough manner and AD yells at daycare children may have occurred, however is not supported or proven by evidence. Therefore, the above allegations are unsubstantiated. An exit interview was conducted and a copy of this report and appeal rights were discussed and provided to Owner Sally Chenoweth. A notice of site visit was also provided and must remain posted for 30 days.

This requirement was not met as evidenced by: Based on interviews C1 was left unsupervised on the playground for several minutes and this incidnet was not reported to Community Care Licensing which poses a potential health, safety or personal rigths risk to children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    (a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: Based on interviews revealing that C1 was left unsupervised on the playground for 3-10 minutes which poses an immediate health, safety and or personal rights risk to children in care.
