What the inspector wrote

Per review of attendance records, 27 preschool children arrived between the hours of 6:48 am-9:07 am with three staff (two teachers and an aide) present, and at approximately 8:08 am, one of the teachers went to the infant classroom to maintain ratio there. Once that teacher was gone, that left one teacher and one aide with 27 children until a qualified teacher arrived at 9:22 am. Confidential interviews and document review also disclosed that facility was out of ratio for approximately one hour. Records review also disclosed to LPA that the CCC does not have transcripts available for substitute aide. It was also alleged that on an unknown date that a teacher was alone with 16 children on the playground. LPA was unable to corroborate whether or not this did or did not occur. Regarding the allegation that facility staff are not providing adequate supervision to day care children, it was alleged that on or about January 9, 2023, a child was left alone in the bathroom by an aide. Confidential interviews disclosed to LPA that the aide took a child into a restroom to change the child’s pull-up/diaper and then the aide discovered the child’s pull-ups/diapers were in the bathroom across the hall. The staff then left the child in the bathroom and went to get the pull-up/diaper from the bathroom across the hall. It was also disclosed to LPA that when the aide returned to the bathroom where child was left alone, the child had removed the pull-up/diaper, smeared feces on child’s shirt and feces was on the floor. This incident was confirmed by owner and the Director. It was also alleged that on or about January 9, 2023, a child ran out of the open door to the three-year-old’s classroom towards the front door of the facility. LPA was unable to corroborate whether this incident did or did not occur. Based on confidential interview and records review, the preponderance of evidence has been met and the allegations that facility staff are operating out of ratio and facility staff are not providing adequate supervision to day care children are substantiated. The facility is being cited for violation of Title 22 Section 101216.3 Teacher-Child Ratio and Section 101229 Responsibility for Providing Care and Supervision which posed a potential health, safety and/or personal rights risk to children in care. See LIC 9099-D for cited deficiencies. An exit interview was conducted and a copy of this report and appeal rights were discussed and provided to Director Sarah Daniel. A notice of site visit was also provided and Director reminded the notice must remain posted for 30 days. Most of the children were gone home before the water was repaired. Confidential interviews disclosed that a plumber was called and the water was only off intermittently for a few hours. It was approximately turned off about 10:00 am and back on approximately 2:30 or 3:00 PM. Per confidential interviews, the CCC puts water jugs in the refrigerator at night for the following day, so children had water to drink during the outage. In addition, some of the children come to school with their own sippie cups filled with water. There was a brief issue with the water, but it was turned on when necessary for bathroom usage, diapering, etc. and then turned back off. Based on confidential interviews, the allegation that the facility does not have running water, may have occurred, however are not supported or proven by evidence. Therefore, the allegation is unsubstantiated. An exit interview was conducted and a copy of this report and appeal rights were discussed and provided to Director Sarah Daniel. A notice of site visit was also provided and Director reminded the notice must remain posted for 30 days.

This requirement was not met as evidenced by: Based on confidential interviews and records review on the morning of January 26, 2023, a teacher and substitute aide provided care for 27 children which posed a potential health safety or personal rights risk to persons in care.

This requirement was not met as evidenced by: Based on confidential interviews and records review on or about January 9, 2023, an aide left a child alone in bathroom and child smeared feces on self and floor which posed a potential health safety or personal rights risk to persons in care.
