What the inspector wrote

Licensing Program Analyst (LPA) Kelly Gerth conducted an unannounced annual inspection for a Large family childcare on the above date and time. LPA met with Licensee Grace La Cruz who guided LPA on a tour of the home. There were 10 child present with Licensee and one assistant when LPA arrived. The facility operates Monday through Friday from 07:00AM to 05:00PM each day. Certain areas are off-limits, including the second and 3 rd floor of home, garage and side yards. The facility is licensed as a Large Family Child Care Home (FCCH) with a maximum capacity of 14 children and is operating within the licensed capacity of the license. The fire clearance for a large family childcare was approved on by 01/23/23 by the Fallbrook Fire Department. A working telephone is available, and the current phone number on file is correct. A fully charged fire extinguisher (2A:10BC) was observed, along with a functioning smoke detector and carbon monoxide detector. All hazardous items, including toxins, are stored securely and are inaccessible to children. Weapons are present and are stored according to Title 22. Grace La Cruz, understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 Regulations. Stairs are barricaded with a baby gate when children are in care. The facility provides clean, safe, and age-appropriate toys for children. A current roster is on file. The required postings, including the Facility Sketch, Emergency Disaster Plan, and Notification of Parent\342\200\231s Rights, are displayed. Fire and disaster drill documentation is maintained, with the last drill conducted 08/08/2025. Page 2 LPA observed an inground pool land spa located in the backyard of the home and at this time LPA observed Licensee not to be in compliance with Assembly Bill 2866 and Title 22 regulations for an in ground swimming pool, and observed the following including: Licensee did not have evidence of a A United States Coast Guard approved Life Ring, A Rescue Pole with a fixed length of at least 12 feet, body hook, A Daily Pool Inspection Log. Additionally, Licensee did not have evidence of a pool cover or pool alarm. The outside surface area was not free of protrusions, cavities, or other physical characteristics that would serve as handholds or footholds that could enable a child to climb over the enclosure, and licensee understands the corrections needed. A fencing enclosure surrounding the pool and made of mesh. LPA measured to ensure the enclosure is a minimum of 60 inches in height, has a max vertical clearance of 2 in. from the ground to the bottom of the enclosure . LPA observed a hole in the mesh fencing panel approximately 5 inches x 5 inches. LPA observed the gate to swing open and away from the pool with a key lockable device measuring no lower than 60 inches however the self latching portion was in disrepair. A citation will be issued. Children's records were reviewed and are complete. Resident and staff records were reviewed and are complete. All adults requiring caregiver background checks have not received the necessary clearances and exemptions. A deficiency will be issued. Licensee Mandated Reporter Training has been completed and is valid, Licensee has evidence of a current Pediatric CPR and First Aid certification and Health and Safety Certificate was completed. Licensee Grace La Cruz was reminded that all adults 18 and over, living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with Licensee Grace La Cruz, and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Page 3 Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP . Additionally, there is a link to \342\200\234Receive Important Updates\342\200\235 located on the right side of the page, immediately above Quick Links. One can add their email address and choose which program(s) they wish to receive Provider Information Notices (PIN) for. The Licensee was reminded of their reporting requirements and provided with the Regional Office\342\200\231s Unusual Incident Reporting email mailbox: UnusualIncidentReportsDO10@dss.ca.gov The Duty Officer is available to answer questions Monday \342\200\223 Friday; 8:00am to 5:00pm at: 951-782-4200 On this date, 08/19/2025, the California Attorney General - Megan\342\200\231s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. To improve the quality and value of the new inspection process, a survey may be sent to the email address provided. Please complete the survey and share your inspection experience. There are deficiencies being cited on the attached 809-D page. Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to Licensee. An exit interview was conducted, where appeal rights and a copy of this this report were reviewed with and handed to Licensee Grace La Cruz. A notice of site visit was given and must remain posted for 30 days.

    Based on observation and interview, the licensee did not comply with the section cited above in the pool enclosure/fence had a hole in a side fence panel measuring approximately 5 inches x 5 inches, and a self-close and have a self-latching device that does not fully self-latch without assistance from licensee, which poses/posed a potential health, safety or personal rights risk to persons in care.
