What the inspector wrote

On 04/16/2025 Licensing Program Analyst (LPA) Kelly Gerth conducted an unannounced Case Management inspection, in response to information received from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). LPA met with Director Rosa Mendoza, who was informed of the reason for the visit. LPA Gerth was provided LIC 9276 - Child Care Center Sampling Checklist, LIC 9275 - External Water Sampler Self-Certification, and LIC 999 Facility Sketch and lead testing results dated October 31, 2024. The results provided from SWRCB, indicated that the facility had elevated levels of lead in water used for drinking and/or the preparation of food and the department was notified of the Action Level Exceedance (ALE). LPA observed on the report provided by the SWRCB that the Faucet(s) J, K, L, N, O, Q identified as having high levels of lead at 6.2-13 ppb were located in rooms not yet being used by the facility and are pending capacity increase. The director also confirmed that the water faucets in exceedance at the facility were not in use by the children during the time which there was an exceedance found and the areas containing these sinks were off limits, which LPA confirmed during the visit. Additionally, Licensee provided proof of a second water/lead testing visit conducted on 12/3/24 when the faucets indicated as previously having exceedances were retested after the Licensee made corrections to the faucets. Upon retesting the above identified faucets were found to be in compliance and no longer in exceedance. To date, the rooms continue to remain unused by staff and children and are pending capacity application increase. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 , requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. Exit interview conducted and report was reviewed with Director Rosa Mendoza. A copy of this report and notice of site visit were issued and Licensee understands the notice of site visit must remain posted for the next 30 days. This report must be available for review, upon request, for the next 3 years.
