What the inspector wrote

On day and time listed above, Licensing Program Analyst (LPA) Keely Messerschmidt, made an unannounced Case Management inspection, for reported Lead Exceedance. LPA met with Director Jessica Escobar notifying her the reason of todays visit. There were 3 children present during the inspection with 2 staff members. LPA Keely Messerschmidt interviewed the Director and examined the faucet deemed an Action Level Exceedance. Label A: Faucet reported with 5.7 ppb or greater lead exceedance levels were as follows: 1 faucet identified as having high levels of lead. The faucet is located in the staff lounge kitchen. Director stated that the piping has been inspected and are pending repairs. Director also stated this sink is located upstairs in the staff lounge and is never used by staff or children. Label G: Faucet reported with 12 ppb or greater lead exceedance levels were as follows: 1 faucet identified as having high levels of lead. The faucet is located in Classroom A. Director stated that the piping has been inspected and are pending repairs. Director also stated that this classroom has never been in use since the facility opened due to low enrollment. Staff and children do not have access to this sink and it is not in use. Based on records review and information received after January 1, 2023, and current policies and procedures for the Department, the facility is being cited for having a lead exceedance in faucet labeled letter G, under the Written Directives, Section 101700.3 (b) (1) California Lead Action Level at Child Care Centers. This poses a potential health, safety, or personal rights risk to the children in care. An exit interview was conducted, a copy of this report, LIC809D and appeal rights were handed to facility Director, Jessica Escobar. A notice of site visit was given and must remain posted for 30 days.

    California Lead Action Level at Child Care Centers(b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an : Action Level Exceedance. This requirement was not met as evidenced by, based on records review and interviews, facility tested over the Action Level Exceedance at 12, in one faucet in Classroom A. This poses a potential health, safety, or personal rights risk to the children in care.
