What the inspector wrote

On 09/18/2023 at 11:30am, Licensing Program Analysts (LPAs), Selina Siao and Sherlynn Banas conducted an unannounced case management inspection for the Action Level Exceedance (ALE) of lead detected in facility water fixture. LPAs met with licensee/Director Joanne O'neil and conducted a tour of the facility. The purpose of the inspection was explained and facility was toured. Present in facility were 23 children supervised 5 staff members. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 , requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. LPA obtained copies of the External Water Sampler Self-Certification Form (LIC9275), Child Care Center Sampling Checklist (LIC9276) and Facility Sketch (LIC999) on 07/13/2023. On 05/19/2023 the Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples were collected on 05/04/2023. The outlets/fixtures reported with 5.5 ppb or greater lead exceedance levels is as follows: B \342\200\223 Drinking fountain located at the playground. Facility no longer utilizes the drinking fountain located in the playground. Facility turned off the water at the drinking fountain which is confirmed during today's inspection. Facility currently uses the kitchen sink water to refill the children's water bottle as needed. Licensee stated that she will not use the water fountain until it get retested and be free of lead. See LIC809D for type B citation issue. Exit interview conducted and report was reviewed with facility representative. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
