What the inspector wrote

On 02/02/2024 at 1:20pm, Licensing Program Analysts (LPAs) Selina Siao and Sherlynn Banas conducted an unannounced complaint inspection for the complaint received on 12/11/2023. The purpose of the inspection is to delivering findings on the above reference allegations. LPA Siao conducted the initial complaint inspection on 12/13/2023. Throughout the course of investigation, interviews were conducted with several staff members including the Director that had knowledge about the window that broke on 10/12/2023 in the Preschool B classroom. Interviews were also conducted with several daycare parents. Director confirmed that on 10/12/2023, there was an incident during nap time in the Preschool B classroom, where the window broke after a child pushed the window. As a result of the incident, the child sustained an injury requiring medical treatment on the arm on 10/12/2023. The incident was not reported to the licensing department as Director stated that the Risk Management said that they would take care of it. As of today, the Director does not have any supporting document to show that the incident was reported to licensing. Based on LPA's interviews and records reviewed, the preponderance of evidence standard have been met regarding the above allegations, therefore the above allegations are found to be substantiated, per title 22 regulation 101238(a) and 101212(d)(1)(B) are being cited on the attached LIC 9099D.

This requirement is not met: On 10/12/23, a day care child sustained an injury that requires medical treatment and facility did not report the incident to Licensing.

This requirement is not met as evidence by: On 10/12/2023, one of the window in the Preschool B classroom broke after a child pushed the window. As a result of the incident the child sustained an injury that required medical treatment. This poses a potential health and safety risk to children in care.
