What the inspector wrote

On 03/24/25 at 9:15 am Licensing Program Analyst (LPA) Gerald Poindexter made an unannounced case management visit. LPA met with Ana Pacheco, assistant director. Monica Collins, center director, was not present, today. Observed today were 50 children in 3 classrooms (one classroom is closed for pending renovation) with 7 staff members. Facility is within ratio and capacity. The purpose of the visit was to follow up on the status of temporary window barricades that Ms.Collins, agreed would be put in place following previous, multiple incidents of broken windows at the facility. Another purpose was to discuss with Ms. Collins the status of a remediation plan for repair of facility windows. Specifically, in a written statement, to LPA Poindexter dated 1/27/25, Ms. Collins stated that “we will still be creating barriers to prevent the children from having direct access to the windows.” Ms. Pacheco stated that she was unaware of the status of a repair plan for classroom windows nor aware of instructions for barriers needed for the windows. During today’s visit, LPA toured inside preschool classrooms and walked the perimeter of the building, directly outside the classrooms. LPA observed that nearly all windows in each classroom were still accessible to children. There were not barriers (such as bookshelves, or other furniture) to all the interior windows or outside windows. A Plan of Correction is still necessary to make all classroom windows inaccessible. See LIC809D for deficiency cited. Exit interview conducted and report was reviewed with Ana Pacheco, assistant director. A Notice of Site Visit was given and must be posted for 30 days. Appeal Rights provided.

    101223(a)(2) Personal Rights: a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. (2)To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by: Based interview and observation, the licensee did not comply with the section cited above, nor with the center director’s written statement that preventative barriers would be put in place to make indoor and outdoor windows inaccessible to children. This poses a potential health, safety or personal rights risk to persons in care.
