What the inspector wrote

The preponderance of evidence standard has been met; therefore, the above allegation is found to be substantiated. California Code of Regulations, (Title 22, Division 12 & Chapter 3, is being cited on the attached LIC 9099D and an immediate civil penalty of five hundred dollars ($500), is being assessed on the attached LIC 421IM, H&S section 1597.58(c)(2). LPA, Rajani Goudreau, informed licensee that this report dated 03/01/22 documents a type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. LPA, Rajani Goudreau, also informed the licensee to provide a copy of this licensing report dated 03/01/22 that documents the Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the licensee, Rosa Gurmilan.

(a) - The licensee shall be present in the home and shall ensure that children in care are supervised at all times…This requirement was not met as evidenced by: Based on licensee’s admission, interviews conducted, and records reviewed the licensee did not ensure a daycare child was supervised at all times, as C1 left the front yard unsupervised, which poses an immediate Health and Safety risk to children in care.

(b) - The licensee shall report to the Department …(2) - Any child absence…any child in care who wanders away from the Family Child Care Home…shall be reported even if the child is later found safe.This requirement was not met as evidenced by: Based on licensee’s admission and record review, licensee did not comply with the section cited above as licensee didn’t report the incident to the department timely regarding C1 wondering away from the facility unsupervised, which poses a potential health, safety risk to the children in care.
