What the inspector wrote

On November 6, 2024, at 12:35 p.m., Licensing Program Analyst's (LPA's), Gloria Gonzalez and Danielle Anderson conducted an unannounced Annual/Requried Inspection and met with Licensee, Rosa Gurmilan.\302\240 LPA disclosed the purpose of the inspection and was granted entry into the facility by the Licensee.\302\240 Six (6) daycare children and one (1) staff member was present in the facility during this inspection. This facility is a 1 story, 5 bedroom, 2 bathroom house. Licensee accompanied LPA inside and out of the facility during this inspection. The following areas used for child care are: Living room, dining room, kitchen, back daycare room, bedroom #1, and both bathrooms, partial backyard and front yard. Off limits areas are bedrooms #2-5 and the garage, and are inaccessible through use of locked door and door knob covers. Hours of operation are: Monday - Friday, 6:30 am -5:30 pm The fire extinguisher, smoke detector, and carbon monoxide detector met requirements.\302\240 Not all hazardous items were made inaccessible to children during the inspection. The licensee has toys, play equipment and materials available.\302\240 The home has a fenced backyard available for outdoor activities at time of inspection. Licensee shall supervise children during outside activities at all times. No bodies of water observed on the premises during the inspection. Licensee stated there are no weapons in the home. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances . Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Licensee\342\200\231s First Aid and CPR certification expires on 10/2026.\302\240 Licensee has required immunizations.\302\240 Licensee completed Mandated Reporter Training on 8/8/2023.\302\240 Licensee did not provide a current mandated reporter certificate for Helper #1. Facility roster is maintained and was reviewed.\302\240 The last fire and disaster drills were conducted and documented on 7/30/2024. There is one crib or play yard for each infant who is unable to climb out of the crib or play yard.\302\240 Cribs or play yards are free from all loose articles and objects. Licensee shall physically check or physically checks on sleeping infants up to 24 months of age every 15 minutes.\302\240 An Individual Infant Sleeping Plan [LIC 9227 (3/20)] is or shall be maintained for each infant up to 12 months of age.\302\240 Licensee states she places or Licensee shall place infants up to 12 months of age on their backs for sleeping. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA provided and discussed the following:\302\240 Report suspected child abuse and neglect, maintain children\342\200\231s records according to regulation, post all required forms.\302\240 Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare.\302\240 Licensee was also provided information regarding SIDS, Lead exposure and Shaken Baby Syndrome. LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov .\302\240 During the exit interview, Licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. LPA advised if there is an unusual incident to report to call Licensing within 24 hours and to follow up with an LIC624B within 7 days. LPA discussed and provided Licensee with the following: child care advocates email address: childcareadvocatesprogram@dss.ca.gov . Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: https://www.ada.gov/resources/child-care-centers/ . LPA advised the Licensee that prior to making alterations or additions to the home or grounds, the Licensee shall notify the Department of the proposed change. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. 2 Type B deficiencies are being cited during today's inspection, see LIC809D To improve the quality and value of the new inspection process, a survey may be sent to the email address provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. LPA interpreted and explained the inspection report to licensee in Spanish, licensee stated she understood. An exit interview was conducted and report was reviewed with the licensee Rosa Gurmilan.
