What the inspector wrote

On 10/3/23 at 12:30pm Licensing Program Analyst (LPA) Patrick Ma conducted an unannounced annual inspection. Upon arrival, LPA identified himself and provided his badge to Licensee Jacqueline Cortez. Also, in the home was Makayka Benton. Licensee was provided the Inspection Checklist (LIC 126). The 2 story home was toured and inspected to ensure an environment safe for the care and supervision of children. Present in the home were 6 day care children. Licensee has provided adequate space for the children to eat, sleep and play within the home. Areas used for child care include dining room (formerly called feeding room), daycare room, downstairs bathroom, and fully fenced backyard area adjacent to the daycare room. Off limits areas include entire upstairs, living room, kitchen, and garage and are inaccessible through use of gates and door knob covers. The licensee has sufficient toys and equipment available. The home has a fully fenced backyard area available for outdoor activities. Licensee understands that supervision is required at all times during outdoor activities. LPA conducted child care quality management interview with the Licensee. The fire extinguisher, smoke detector, and carbon monoxide detector meet requirements and are operational. Garage is missing safety mechanism to ensure it is inaccessible to children and will need to be corrected by 10/13/23. There is no body of water on the property. Licensee states that there are no weapons in the home. First Aid and CPR certifications expire on 6/11/24. Licensee has required immunizations. Licensee was reminded Mandated Reporter Training must be completed every 2 years with current certificate on file at the facility. Children\342\200\231s and Staff records were reviewed. Provider is hereby reminded of the following: Report suspected child abuse and neglect, maintain children\342\200\231s records according to regulation, post all required forms; corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers are not allowed in day care. All equipment that is used should be used only as intended by the manufacturer. LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov. During the exit interview, the LICENSEE Jacqueline Cortez, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA reviewed with Licensee the LIC 311D, Forms/Records. To Keep In Your Family Childcare Homes, children\342\200\231s forms/records, facility forms/records, and information to be posted. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.     Based on observation the garage, living room, and kitchen were missing barriers and mechanisms prohibiting access to those unlicensed areas when LPA first arrived for inspection which poses/posed a potential health, safety or personal rights risk to persons in care.

  • ARTICLE 2. Administration of Child Day Care Licensing

    Based on records review, staff S1 and Licensee was unable to present LPA with current Mandated Reporter certificates. Licensee was also unable to find S1's file and only had her negative TB screening on record. S1 is fingerprint cleared and associated but is missing her immunizations, current FA/CPR certificate, LIC 9108, and LIC 9052 which poses/posed a potential health, safety or personal rights risk to persons in care.
