What the inspector wrote

On 6/10/24 at 9:08 a.m., Licensing Program Analyst (LPA) Renita Rodriguez conducted an unannounced annual inspection with the Licensee. Upon arrival, LPA identified herself. LPA met with Licensee, Silvia Villegas. The home was toured and inspected to ensure an environment safe for the care and supervision of children. The home consists of 4 bedrooms, 3 bathrooms, 2 living rooms, dining room/playroom, kitchen, and a separate detached garage. Silvia Villegas owns the home. 11 children, licensee and licensee daughter/helper Melissa Villegas were present in the home. Licensee has provided adequate space for the children to eat, sleep and play within the home. Areas used for childcare include 1 living room, dining room/playroom, bathroom, and back yard. Off limits areas is the detached garage and is made inaccessible by lock and key. The licensee has sufficient toys and play equipment available. The home has a fenced backyard available for outdoor activities. The fire extinguisher (3A40BC), smoke detector, and carbon monoxide detector meet requirements and are operational. All hazardous items were latched/locked and secured out of reach of children. There is no body of water on the property. Licensee states that there are no weapons in the home. First Aid and CPR certifications expire on 12/2025. Licensee has required immunizations. Licensee will complete Mandated Reporter Training by 6/17/24 and is reminded it must be completed every 2 years. Children\342\200\231s and Staff records were reviewed and found to be in order. LPA discussed the safe sleep regulations with licensee [or facility representative] and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Licensee is hereby reminded of the following: Report suspected child abuse and neglect, maintain children\342\200\231s records according to regulation, post all required forms; corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers are not allowed in day care. LPA directed Licensee to website: https://www.cdss.ca.gov/inforesources/community-care-licensing to receive important updates and information. On this date, 6/10/24, the California Attorney General - Megan\342\200\231s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov . A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Childcare Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA discussed and provided Licensee with the following: childcare advocates-email address: childcareadvocatesprogram@dss.ca.gov . In addition, for general questions or questions regarding licensing requirements contact the Childcare Licensing Duty Line at (619) 767-2248. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Childcare Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Childcare Centers and the ADA, available at: http://www.ada.gov/childqanda.htm . There were no children present requiring services. Exit interview conducted and report was reviewed with the licensee, Silvia Villegas. During the exit interview, the Licensee, Silvia Villegas confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Technical Violation 1596.8662(b)(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training A notice of site visit was given and must remain posted for 30 days.
