On 10/29/2024 at 9:30am, Licensing Program Analyst (LPAs) Oscar Picazo and Gloria Gonzalez conducted an unannounced Annual/Random Inspection and met with the licensee Maria Garcia. Upon arrival, Licensee was not home but LPA\342\200\231s were greeted and granted entry to the home by Licensee\342\200\231s adult daughter and assistant Jessica Garcia as licensee was at an appointment. LPA Picazo disclosed the purpose of the inspection and was granted to tour the facility by the assistant. Licensee arrived approximately at 10:00 am and took over the guided tour. This single story 3 bedroom, 2 bathroom home was toured and inspected. Licensee is using the following areas for day care: living room, kitchen/dining room, hallway bathroom #2, child care room and fenced front yard. Off limit areas include: Master bedroom 1 and bathroom 1, bed room 2 and bed room 3, hallway closet, garage and backyard. Outside play area in front yard is completely fenced. Hours of operation are Monday \342\200\223 Friday 7:00 am -5:30pm. The licensee, 2 staff and six children were present in the facility during this inspection. The fire extinguisher and smoke/carbon monoxide detector met requirements. The licensee has available toys, play equipment and materials. Children play outside in the fenced front yard. Licensee had previously submitted documents to move the outside play area from the back yard to the front yard. This area has been inspected and approved for outside activity use. Licensee was reminded that continuous supervision is to be given to children whenever engaged in outdoor activities. No bodies of water were observed on the premises during the inspection. Licensee stated there are no weapons in the home and LPA did not observe any firearms at the time of this inspection. Licensee\342\200\231s First Aid and CPR certifications expire in June 2025. Licensee has required immunizations. Licensee completed the Mandated Reporter Training and valid until 6/2026. The facility is maintained and was reviewed. Licensee was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5- days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. On this date, 10/29/2024, the California Attorney General - Megan\342\200\231s Law website (meganslaw.ca.gov) was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. A copy of the report and appeal rights (LIC 9058) was provided to the Licensee and notice of site visit (LIC9213) was given to Licensee and was advised it must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
