What the inspector wrote

On September 28, 2022 at 9:15 a.m. Licensing Program Analyst (LPA), Leilani Curtis conducted an unannounced annual inspection and met with Licensee, Ana Alvarez. Also present was the licensee’s helper/mother Hortencia Bibo. In addition to conducting an annual inspection, LPA addressed the licensee’s request to increase her capacity from 8 to 14 children. LPA provided the LIC 126, Entrance Checklist to Licensee. There was one infant child in care. Facility was observed operating within ratio and capacity. LPA conducted a tour of the home inside and outside per facility sketch. Licensee is using the following areas for daycare: living room, kitchen, T.V. room/day care room, bathroom #1 and enclosed rear yard. Off-limits areas include: bedroom #1, bedroom #2, bedroom #3, bathroom #2, front yard and the dirt area of the rear yard. The licensee states that the daycare children are not allowed to use the trampoline located in the dirt area of the rear yard. Licensee has provided adequate space for the children to eat, sleep and play within the home. Home is clean, orderly and has adequate ventilation. Children’s toys and play equipment are available and observed free of hazards. There are no stairs in the home. There is a working telephone/email address. All cleaning compounds, detergents, medications, and poisons are made inaccessible through latches, locks, and/or placed up on high surfaces. There is no fireplace. The fire extinguisher and smoke and carbon monoxide detector are operational. Licensee states there are NO firearms or other weapons in the home. The outdoor play area is fenced and free of hazardous items. There is a fenced swimming pool in the rear yard. LPA and Licensee observed that the gate to the swimming pool did not consistently self-latch. LPA closed the gate from different distances and observed that the gate only occasionally latched. The licensee states that the gate has not closed properly for approximately four months. Children records were reviewed for Emergency Information. The child present at the time of inspection did not have the LIC627, Consent for Emergency Medical Treatment on file. LPA reviewed a total of four children’s files. There were no insurance affidavits, LIC282, in any of the children’s files. LPA discussed the infant safe sleep regulations with Licensee. There are no new adults living or working in the home over the age of 18 years. All adult residents and helpers have submitted or been cleared for criminal record and child abuse index clearances or exemptions. Pediatric CPR and First-Aid certificates for Licensee and her helper are valid through July 2024. The licensee’s mandated reporter certification expired 9/12/22. The licensee did not have a current mandated reporter certificate for her helper. Immunization records per SB792 were reviewed and are in compliance. The last documented disaster/fire drill occurred on 11/18/2015. The home appears to be large enough to comfortably accommodate 14 children. An updated facility sketch has been received and a fire clearance for 14 children was granted on 9/6/22. This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. The licensee will send LPA a copy of her Incidental Medical Services Plan, of Operation by 10/28/22. LPA reviewed the following with Licensee: Recently Approved Safe Sleep Regulations PIN 20-24-CCP dated 9/15/20, California Department of Public Health Guidance for Child Care Providers and Programs dated 3/12/22 and emergency drills. Licensee is reminded that corporal punishment, smoking, walkers, exersaucers, jumpers and bouncy seats shall never be permitted during daycare operation. Licensee is aware that interference with a child’s daily functions, corporal punishment, physical and mental abuse is not allowed. Licensee is reminded to make anything that reads, "Keep Out of Reach of Children" inaccessible to children. See LIC809D for cited deficiencies. A civil penalty has been assessed. Prior to licensure of a capacity of 14 children, all deficiencies listed on the LIC809D must be corrected. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee. LPA Curtis informed licensee that this report dated 9/28/22 documents one Type A citation . Type A citations shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care. Also, LPA Curtis informed the licensee to provide a copy of this licensing report dated 9/28/22 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
