What the inspector wrote

On October 18, 2022 at 9:50 am, Licensing Program Analyst (LPA) Jessica Rubio arrived at the facility to conduct an annual inspection as part of a compliance review. LPA met with licensee Carline Hinds. LPA toured the facility, inside and out, records were reviewed, and the following was observed and/or discussed: \302\267 Normal days and hours of operation are: Monday through Friday 7:00 am to 4:00 pm \302\267 Off-limit areas include: Bedroom #1, Master bedroom, bathroom #2, garage and loft. \302\267 The facility is operating within the licensed capacity and appropriate ratios. LPA observed five children with licensee and assistant providing care. \302\267 Appropriate supervision was provided during this inspection \302\267 A working telephone is present and the current number is on file \302\267 Appropriate fire extinguisher, smoke detector and carbon monoxide detector were present and tested by the Licensee during this inspection. Smoke detector and carbon monoxide detector were working properly. \302\267 Fireplace is properly screened to prevent access by children \302\267 All hazardous items were not stored inaccessible to children. LPA observed an unlocked hall closet with bleach, several toiletries in the children's bathroom cabinets labeled "Keep out of Reach of Children" and gardening tools and paint in the backyard. A citation will be issued. \302\267 Weapons are not present in the facility as stated by Licensee. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 Regulations \302\267 Clean, safe and age appropriate toys \302\267 Current roster on file \302\267 Facility Sketch, Emergency Disaster Plan and Notification of Parent\342\200\231s Rights poster are posted \302\267 Documentation of fire and disaster drills on file \342\200\223 Last drill conducted on 9/15/2022 \302\267 No bodies of water at this time. Licensee understands all bodies of water including ponds, above ground pools & spas, in-ground pools & spas, and some fountains must be properly covered or fenced per Title 22 Regulations. The Department must be notified before and after installation of the above types of bodies of water. In addition, all wading pools or similar product must be emptied immediately after use and stored in an upright position. \302\267 Verification of control of property on file \302\267 During this inspection, 5 children\342\200\231s records, licensee and assistant\342\200\231s records were reviewed \302\267 All five children\342\200\231s records are complete. \302\267 Licensee\342\200\231s records were complete. Assistant was missing mandated reporter training. A citation will be issued. \302\267 Licensee\342\200\231s Mandated Reporter Training is completed and expires on 8/10/2024. \302\267 Licensee\342\200\231s Pediatric CPR and First Aid Card expire on 5/2023 \302\267 Health & Safety Certificate - completed in July 2011 \302\267 Resident and/or staff records were reviewed and all adults who require caregiver background checks have not received all required clearances and/or exemptions. LPA observed and interviewed licensee and determined licensee's son whom resides in the home turned 18 and has not obtained a criminal record clearance. A citation will be issued and civil penalties assessed. The licensee confirmed that there are no Registered Sex Offenders living in the facility and/or using the facility address for their mailing address. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm The Licensee was informed of their reporting requirements and was provided with the Regional Office\342\200\231s Unusual Incident Reporting email mailbox: UnusualIncidentReportsDO10@dss.ca.gov The Licensee can submit transfer forms to associate new individuals or to disassociate someone from the facility at: Associations_Disassociations858@dss.ca.gov LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. If a civil penalty has been assessed during this inspection, payment is due when billed and the check(s) or money orders shall be made payable to the \342\200\234California Department of Social Services\342\200\235. You will receive an invoice in the mail. Do not send money until you receive your invoice. Do not send cash. The facility is being cited for Title 22 Regulation Section 102370 (d)(1), 102417 (g)(4) and Health & Safety Code Section 1596.8662 (b)(1) . See LIC809-D for cited deficiencies.
