What the inspector wrote

On 6/15/22, Licensing Program Analyst (LPA), Tyra Block made an unannounced complaint visit for the complaint received on 4/14/22 for the purpose of delivering findings on the above referenced allegation. Present at the faciity with Mrs. Romero were 11 children (3 infants) and 2 helpers. The facility was within ratio and capacity. All adults had criminal background check clearances and were associated to the facility. LPA interviewed parents, former staff, and current staff. Based on the information obtained during interviews and observations it is determined that the allegation is valid because the preponderance of the evidence has been met, therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12, Chapter 1). A type A deficiency is being cited on the attached LIC 9099D. The Notice of Site Visit was provided, licensee is advised it must be posted for 30 days. An exit interview was conducted with Mrs. Romero. Upon Receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 ws provided.

    102423(a)(4) Personal Rights- Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following:To be free from corporal or unusual punishment...infliction of pain, humiliation, intimidation...or other actions of a punitive nature, including, but not limited to: interference with...sleeping....This requirement was not met as evidenced by: Based on the information obtained during interviews and observations Mrs. Romero inappropriatley handled a child during naptime violating their personal rights. This poses an immediate risks to the health and safety of children in care.
