What the inspector wrote

This is an amended version of the original report created on 12/09/2022. Licensee stated she would leave the home in the mornings to conduct drop offs and leave C1 alone without adult supervision to care and supervise the daycare children. During an inspection on October 12, 2022, LPA observed a baby rocker located in the daycare area/living room of the home. Licensee confirmed to use the rocker on multiple occasions dates unknown for the infants in care during nap and awake times. Licensee confirmed to care for one family’s children; four siblings for longer than 24 hours on two separate occasions. Licensee submitted sign in and out sheets reflecting the children were in care from June 10th through the 12th, 2022 from 2:00 p.m. to 10:30 p.m. (56 hours), and August 23rd through the 24th from 10:23 a.m. to 4:46 p.m. (30 hours). Furthermore, licensee confirmed to supervise the daycare children in off-limit areas of the home. According to licensee, the children that were in care for 24 hours or longer were able to go in the off-limit areas of the home; including the kitchen and the three bedrooms of the home. Based on licensees’ admissions, observations and interviews conducted with parents and children in care, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, (Title 22, Division 12 & Chapter 3), is being cited on the attached LIC9099D and an immediate civil penalty of five hundred dollars ($500), is being assessed on the LIC 421IM. LIC421IM manually generated as unable to assess civil penalty on the LIC9099D page. LPA, Rajani Goudreau informed Licensee, Michele Galvez that this report dated 12/09/22 documents two type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care. Also, LPA, Rajani Goudreau informed the Licensee, Michele Galvez to provide a copy of this licensing report dated 12/09/22 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. LIC9213 - Notice of Site Visit was discussed and provided to licensee. LPA observed licensee post the LIC9213 near the front door, prior to exiting the facility. Exit interview conducted and report was reviewed with the Licensee, Michele Galvez. According to licensee, Licensee stated all the children in care are adequately fed. Licensee denied the home not being clean or sanitary. Licensee stated she is always cleaning and sanitizing the daycare throughout the day. Based on observations on October 12, 2022, the home was observed to be orderly. During interviews with parents, no concerns were disclosed regarding the care provided. Based on interviews conducted and observations made there was conflicting information and a lack of evidence obtained to support the above allegations. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
