What the inspector wrote

On June 5, 2026 at 11:07 a.m., an office meeting was held at San Diego Child Care Regional Office to discuss the deficiency and civil penalty assessed on March 12, 2026. In attendance was Licensee, Vanessa Payant, Licensee's husband, Pikenson Conserve; Licensing Program Manager (LPM), Tulam Vu and Licensing Program Analyst (LPA), Angela Nguyen. Licensee stated that her primary language is Haitian Creole. Licensee stated that language services were not needed and declined the service. During this meeting, the following Health and Safety Code & California Code of Regulations were reviewed to ensure a thorough understanding: · Health and Safety Code 1596.78(a) “Family Day Care Home" means a home that regularly provides care, protection, and supervision for 14 or fewer children, in the provider’s own home, for periods of less than 24 hours per day, while the parents or guardians are away, and is either a large family day care home or a small family day care home. · CCR 102417(a) Operation of a Family Child Care Home: The licensee shall be present in the home and shall ensure that children in care are supervised at all times. · CCR 102416.2 (a)(2) Reporting Requirement: Any change in household composition including adults moving in or out of the home and anyone living in the home who reaches his or her 18th birthday. · CCR 102416.5 Staffing Ratio and Capacity (d): For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home, including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10, shall be either: (2)More than twelve and up to fourteen children only if the criteria in Section 1597.465 of the Health and Safety Code are met. On February 26, 2026, during the case management inspection, a type B deficiency, California code of Regulation section 101417(o)(2) was cited due to the licensee did not provide proof of control of property. (o)The licensee shall maintain documentation of proof of control of property... for review.... (2)...the licensee is operating on rented or leased property, "proof of control of property" is a copy of the rental agreement or lease. Technical Support Program (TSP) services and training opportunities were reviewed with the Licensee who was advised to register for Provider Information Notifications (PINs). Licensee, Vanessa Payant was informed that repeated violations or failure to comply with licensing laws and regulations may result in administrative action taken by the Department. Licensee acknowledged the deficiency and affirmed her commitment to maintaining full compliance with all applicable laws and regulations. Please submit any Unusual Incident Reports by email to: SDIncidentReports@dss.ca.gov and the Duty Line 619-767-2248. A copy of the regulations and PIN 26-03-CCP was provided to the licensee. This report was reviewed and a copy was provided to the licensee, Vanessa Payant.
