What the inspector wrote

On 01/09/2025 at 1:30 PM, Licensing Program Analyst (LPA) Oscar Picazo conducted an unannounced case management inspection for the purpose of an increase in capacity with Licensee Yolanda Alvarez. Upon arrival, LPA was granted entry and disclosed the purpose the inspection. The purpose of the inspection is to ensure that the home follows standards established in CCR, Title 22, Division 12, Chapter 3, for Family Child Care Homes. Also present is license's adult daughter, Andrea Alvarez with her 2 infant children who are also licensee's grandchildren; one of whom is enrolled in the day care, two (2) day care preschool age children and 1 school age child who is the licensee's son. Days and hours of operation are Monday through Friday, 7:30am - 5:30pm. On 10/28/2024, a fire clearance was granted for 14 children. LPAs, accompanied by applicant, toured the indoor and outdoor of the home. This is a single story 3 bedroom, 2 bathroom home. Licensee will utilize the following areas for childcare: living room, dining room, kitchen, bedroom #3, bathroom #1, and the fenced front yard. Off-limits areas include bedroom #1, bedroom #2, bathroom #2, backyard and garage. Off limit areas are inaccessible to children by use of child-proof gate, cabinet locks and latches. The licensee owns the home and maintains documentation of proof of control of property for review by the Department. The fire extinguisher is rated 2-A:10-B:C which meets statutory requirements and is located in the kitchen. Smoke and carbon monoxide detectors meet requirements and are operational. Poisons, detergents, cleaning compounds, medications and other hazardous items were made inaccessible to children by cabinet latches/locks and/or placed on high surfaces. The applicant has a working cell phone. Licensee stated there are no bodies of water on the premises and LPA observed no bodies of water during the time of inspection. Licensee stated there are no firearms, other weapons, or ammunition in the home. Licensee was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or See LIC 809C Continuation... exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. Licensee's Mandated Reporter AB1207 training expires 06/05/2026. Pediatric CPR and First Aid certifications expire on 01/2025. Licensee provided verification of recertification enrollment for 01/23/25. A sample of children\342\200\231s files were reviewed and were determined to be complete. On this date, 01/09/2025, the California Attorney General - Megan\342\200\231s Law website (meganslaw.ca.gov) was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. LPA discussed with Licensee the maximum capacity for a Large Family Child Care home: 12 children (with a qualified assistant) with no more than 4 infants; or (with landlord consent) 14 children (with a qualified assistant) with no more than 3 infants, 1 child enrolled in kindergarten or elementary school and 1 child at least age 6 including children under age 10 who live in the licensee's home. When there is no qualified assistant, 14 years of age or present, the capacity reverts to the requirements for a Small Family Child Care. There were no deficiencies cited during this inspection. A copy of the report and appeal rights (LIC 9058) was provided to the Licensee and notice of site visit (LIC9213) was given to Licensee and was advised it must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. A large family childcare home license may be issued upon final file review. An exit interview was conducted and report was reviewed with the Licensee, Yolanda Alvarez.
