What the inspector wrote
On 6/16/2025, at 9:40am, Licensing Program Analyst (LPA), Vicky Williamson conducted an unannounced Annual Random inspection. LPA met with Licensee's assistants Noelle Turpin and Kiya Daley and discussed the purpose of the inspection. There were 10 children present, three (3) of whom are infants. At 10:15am, Licensee, Kody Daley arrived to the facility. Days and hours of operation are Monday through Friday, 7:00am - 5:00pm.
LPA accompanied by Assistant Noelle Turpin toured the indoor and outdoor of the home. This is a single level, four (4) bedroom, three (3) bathroom home.
The following are used
for childcare: family room, daycare room, bathroom 3 and fenced front side yard. Off limit areas include bedroom 1 (master bedroom), bedroom 2, bedroom 3, bedroom 4, bathroom 1 (inside of master bedroom), bathroom 2, laundry room, garage, side yard and pool area. Off limit areas are made inaccessible to children by door safety latches, door key locks, and fencing. Licensee stated that daycare children do not utilize this swimming pool or backyard area. Licensee is reminded that children should always be supervised during outdoor activities.
At 10:35am, LPA observed that the backyard is enclosed with a wood fence and has an in-ground swimming pool and in-ground jacuzzi that does not have an enclosure, fence, wall or other barrier that isolates the swimming pool and jacuzzi from access to the family child care home. LPA also observed that bathroom 3 and another door leading from the daycare room lead into the backyard and to the swimming pool. During time of inspection, both the bathroom door and door leading from the daycare to the backyard were observed to have safety door latches, locks and security doors with key locks. LPA verified prior to arrival, there was were aluminum gates surrounding the in-ground swimming pool and barricading direct access to the swimming pool and in ground jacuzzi.

Licensee acknowledged that he removed the fencing recently due to he felt that the door and security doors are safer and more secure for the daycare children. LPA observed one pool alarm that is operational, however there was not pool alarm in the in-ground jacuzzi. LPA observed a life ring and rescue pole with a body hook that meet pool safety requirements. Daily safety inspection log, of all pool equipment was not available for review during time of inspection. LPA and Licensee discussed the requirements in maintaining a daily safety log inspection. Licensee was provided PIN 25-01-CCP.
LPA was reminded Licensee that prior to making alterations or additions to the home or grounds, the Licensee shall notify the Department of the proposed change. Licensee updated the facility sketch during time of inspection.
The fire extinguisher was not operational during the time of inspection. Licensee stated that the fire extinguisher was used on 6/13/2025 and has not been replaced. Smoke and carbon monoxide detectors meet requirements and are operational. All poisons, detergents, cleaning compounds, medications and other hazardous items in the home are made inaccessible to children through latches, locks, and/or placed on high surfaces. Licensee has children's toys, play equipment and books available. Licensee has a home phone and working cell phone. Licensee stated there are no firearms, other weapons, or ammunition in the home.
Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
Pediatric CPR/First Aid certification for Licensee and both assistants is valid through 8/2026. Licensee and assistants have the required immunization records on file. Mandated Reporter training certification for Licensee is valid through 11/12/2026, Assistant, Noelle Turpin through 4/22/2027, Assistant, Kiya Daley through 7/6/2025. LPA informed Licensee to ensure that Pediatric CPR/First Aid and mandated reporter training is completed once every two years. LPA observed the required documents posted. A sample of children\342\200\231s files were reviewed and were determined to be complete. LPA reviewed documentation for 15 minute sleep checks and they ere are being maintained. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual \342\200\223 Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. LPA discussed safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at

LPA reviewed PIN 20-24-CCP regarding Safe Sleep with licensee. Licensees stated that he understood.
LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at

and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
LPA and licensee discussed and reviewed the following: Report suspected child abuse and neglect, form LIC 311D, maintaining children\342\200\231s records according to regulation, posting required forms. Licensee is reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare. Licensee was also provided information regarding SIDS, Lead Exposure and Shaken Baby Syndrome.

Licensee completed the Health and Safety Issues Family Child Care Regulation 102417 form during time of inspection.
Based on interviews and record review, one (1) Type A deficiency of the California Code of Regulations, Title 22, Division 12, Chapter 3, are being cited on the attached LIC 809D. A Technical Assistance for Health & Safety Code 1596.814(a)(3) was issued.
LPA
informed Licensee, Kody Daley that this report dated 6/16/2025 documents one (1) Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA informed Licensee, Kody Daley to provide a copy of this licensing report dated 6/16/2025 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA provided Licensee, Kody Daley with form LIC 9224.
During the exit interview, Licensee, Kody Daley confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. See LIC 809C Continuation...

A Notice of Site Visit (LIC 9213) was given to Licensee, Kody Daley and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. LPA observed LIC 9213 was posted. Appeal Rights (LIC 9058) was provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
An exit interview was conducted, and the report was reviewed with the Licensee, Kody Daley.
